Does not say anywhere in the TnCs that OCing will void the warranty. Their marketing even promotes OCing. Modifying it does void the warranty though, like putting a new cooler on or changing the paste. They'll know because you'll have to remove the security stickers to do that. I do not think they have a machine that says the card has been overclocked.

I dont think you can tell if a piece of hardware has been OCed unless you damaged it?

| CPU: Core i7-4790K  |  Motherboard:  MSI Gaming Z97 GAMING 5 LGA 1150  |  CPU Cooler:  NZXT Kraken X61 |
| GPU: Single 8GB EVGA GTX 1070 FTW |  RAMCorsair Vengeance 16GB (2 x 8 GB) DDR3 1600 MHz |  CaseCorsair 330R Titanium Edition

Terms and Conditions of the warranty. Similar to EULA = End User License Agreement.

oh okay, its just that i bought a 780TI right before the 9xx's came out and i kinda want to find a loophole to kill my card and not void the warranty and get a 980ti upgrade for free xD

Yes, they will know if you try and kill your card.

You are also not guaranteed to get a "free upgrade" to a 980Ti. You need to check your T's and C's carefully as it could be that they will replace the unit like for like or (if they have none in stock) they may only credit you with the current value/the value of a card with the same performance as the 780Ti.

7xx are no longer in stock/manufacture line and im pretty sure that i will get a 980ti or at least a 980.

no other store is also selling the 780ti in my country.

They no longer make the cards to sell but that doesn't mean that they don't have them in stock for warranty returns otherwise everyone would get GPU's at the end of the line then kill them to get the next gen and so on. It may surprise you what manufacturers have on their shelves.
