No it isn't, but it is running.  You can run Win10 for a while without registering it.  In the meantime run Win7 on a VM and let that upgrade to 10, then get the key MS gives you for that install and use it on the proper one. 

Actually the upgrade keys seem to be generic ones, people are reporting getting the same key on multiple upgrades.  IF they all use the same key indeed, Googling and entering it shouldn't count as piracy.

I just dont understand how it doesnot work this is a fresh install of Win 8.1 it registered and i can see the upgrade icon
