you can overclock it even it is not water cooled and all the 970's available out there can be overclocked.

 

and I think there is a chance that you posted on the wrong section.. but I'm not sure about that

Oh sorry new to LTT as well, so I don't need to water cool it but when I look at all the 970s for sale there are a whole heap of options with prices verying and arnt sure if some of those were better at over clocking than others, and would I need 3rd party cooling hardware I can't find anything on that?

The MSI gtx 970 gaming is pretty good for overclocking, and quite cheap. As for software you should use MSI afterburner, almost everyone uses that.

Edit: I overclocked mine to +140 core and +480 memory.
