Adobe- "But mah data tho, its what we sell to keep your subscription price extremely high but our profit margins all the way in outer space".

I would just like to point out that these terms have existed since 2016. This isn't new and it's just a prime example of how nobody reads the ToS.

And you have been granting Royalty free access to your data since pretty much the start of Creative Cloud.

While I don't agree with these Terms, nothing has really changed other than them clarifying that it can be accessed via automated or manual methods.

Nevertheless, it has spread across the internet and become a relevant topic. I would like to see it addressed on the WAN show and witness community action against this type of practice.

 

I do some graphic design work. What if I work on projects under an NDA? They could access it without prior notice and use it for any purpose. Essentially, I couldn't use Adobe at all in that situation.

 

There are legal limits to what an agreement can state, including EULAs and TOS. Some companies include unreasonable clauses in their EULAs/TOS that may not be legally binding in many jurisdictions. Some even contain blatantly illegal provisions.

 

This cannot continue unchecked, and action must be taken against these practices.

 

Btw: I'm honestly missing software with no internet access which run on my hardware alone and are not updated unless I decide to. And with lifetime licenses. 

 

By the by: it allows them to train AI models on their customer material without any compensation which is actually a huge deal.
