Honestly if you cant find a retailer selling the game and its not being produced anymore its okay to get it by other means imo

No. For such an old game it's highly unlikely anyone will care - even if they were able to obtain information on your activies, which is highly unlikely in the first place. Should they care, you will most likely be given a notice that you have violated copyright which will warn you to cease. It's unlikely you will face any severe consequences for one breach of copyright law, and certainly won't have anyone breaking your door down over it.

 

As far as I'm aware at least. I'm not an expert on copyright law, so please someone correct me if I am wrong.
