No and no. The fan curve by default is admittedly slightly reserved, but that is easily fixable. Take care of cooling and the 1080 can fly. [below is exaggeration, obviously]

Well I guess it depends on how long you are willing to wait wnd a bit on personal preference, the FE card will do fine with a higher fan curve, max temps and power limit but looks and stuff are subjective. If you can wait a couple of weeks. I would as it will increase availability and lower prices a little. If you really want the card now and are okay with it being a little louder then go with it.

I personally really like the FE design and it holds a lot of status. If I could get one for that cheap I would, though I'm planning on getting a 1070.

My X99 Deluxe and one of my 980 Ti in my main rig, as well as the 380X in my secondary rig are open box from Microcenter.   No problems whatsoever.   I believe they have a 14 day return policy instead of the normal 30 however.
