Is the CPU new or has this happened when it was used already?

Just installed it in the system last night and acted like that since the board is fine and the 3950x I had in it before runs about 10 fps better than the 5700x3d in cyberpunk

There most definitely should not be a fall in performance due to your upgrade..

Assuming the freshly installed graphics card is not faulty and all current stable drivers installed?

The graphics card is fine and confirmed working since I just upgraded
