Is this False Advertisement?

SO i was driving down higway 52 in rochester, MN and i spotted a centurylink banner Stating "NOW OFFERING 40MBS"  yes MBs ........

 

no p to be found no lower case b to be found....

 

SOO i make a phone call.

 

century link guy gives me his speal , then i ask if they have that 40 "MEGA BYTE"  service i say by name.

 

his response is oh yes of course!! i then reply,, so you have 320 Mbps.......

also by name

 

his response !! YES WE DO ITS AWESSSSSOME

 

then i say soo let me get this straight i have charter at 30Mbps. so i really have maybe 3.8 MBs and your saying you have 40?!?!

 

yes sir we do...

 

then i reply.. HOW DO YOU DO THAT?

 

his response: yes through the phone lines! its high speed DSL he says! \

 

my response.. LOLOLOLOLOL     ok man.....sure you do.. lol  click...

The phone guys just read off a guideline. GIve him a break, he probably doesn't know the difference between MB and Mb. They do offer 40Mbps though. Not MB but Mb

Ehh, maybe they do offer that. Call them again and bring it up. Record it. Phone reps are agents of the company, if they tell you that you will be receiving 40 MB/s then they're legally obligated to provide it to you. Alternatively it could be a way to weasel your way into paying 1/8th of their asking price for 40 Mb/s service.

Tired of hearing people say you can't install OS X on AMD hardware. Educate yourself.

I've had a friend who's done that(but in a different scenario).The court rejected whatever he was trying to get from the company which was falsely advertising because,even though they were advertising something else,in the actual contract the right thing was written.He also had to pay the company some money(not too much).

Meh, i don't blame the guy, he's probably just clueless.

 

Most people are clueless to the difference between megabits and megabytes. 

 

people don't understand why they're getting 1.5MB/s when downloading stuff in their browser when they paid for a 12Mb/s plan

Ehh, if he's got a recording of himself asking an agent of the company explicitly whether he'll be receiving 40MB as opposed to 40Mb, it's open and shut. Better business bureau, all that jazz. Though, yeah, if you sign a contract that correctly says 40Mb/s then it all goes out the window. Possibly....

If he has a recording without permission that's wiretapping iirc. Would he be able to get permission? Hell no. And yes, if his contract says 40 megabits per second then it's out the window. Contract will not use acronyms open to misunderstanding due to someone not knowing any better.

naw, it's not wiretapping. It's legal to record a telephone conversation as long as one of the parties is aware it's happening. It's wiretapping when you eavesdrop on somebody else's conversation.

If they say "Up to" technically they aren't lying...

 

If they say up to, then in bast case scenario, it also need to be able to give this. What in this case will NEVER be, so it is false advertisement.
