TL;DR:

If successful, a lawsuit from the Media Industries could force ISPs to heavily monitor users and potentially ban them from Services.

My Thoughts:

With the recent victory against a smaller ISP, the music industry has a potential precedent for future cases that could easily force them to go the same way. While the industry hasn't challenged any of the big players yet, this is definitely something we should be watching.

The thing about using tor is that it's really obvious you are. If an isp wanted to find and track everyone using tor it's really, really easy. So they could just track you and wait for you to slip up or just unravel your trail. 

 

It's really not nearly the security people think it is. It's like walking into a store with a blanket around you that says on the outside "I'm definitely not doing anything illegal" while you rob the place

IPS's arent that dumb. They likely gonna put some low cost measures into effect then leave it running so they cant get into trouble and they dont have to loose customers.... ;)

If this SOMEHOW goes all the way through I'll find some offshore ISP offering Satellite Internet. Can't easy sue a company using US laws if they're not in the US

Problem being that ISP can easily see that you are using TOR but they cannot see for what you are using it. Same thing goes with anything encrypted, ISPs or anyone that gets in the middle of transmission can easily see where data is coming from and where it goes and what protocol is being used but they have no idea what that data is. ISP can easily track down that you are downloading something with p2p-protocol, but they have no idea if that is some update to a game that uses p2p-updating, Linux distribution or the newest Avengers movie.

Okay now it'll be VPNs are banned, TOR is banned, at that point people will have physical P2P connections or line of site connections. I know already people have underground flashdrive swaps

Yeah I feel like people assume that everyone only torrents illegal content. I had a buddy in college that would torrent but wasn't downloading anything illegal.

Pretty sure in countries where the internet is pretty expensive at like $20/hr there's people who make bank by selling flash drives with pirated movies, copies of news, and other relevant daily info. File sharing will always happen

Yeah no way they are going to be able to ban VPNs. Businesses and schools use them quite often. Most firms have VPNs to allow for working from home. And alot of companies use them for similar purposes as well.

I don't have an issue with IP rights holders enforcing their IP (it's quite important to make technology move forward), but Hollywood + the Music Industry make a good argument for praying the San Andreas fault drops LA into the ocean. They failed with SOPA, so this is a back-end approach to it.

 

This is known as "Lawfare", and this is going to play out over years. And it's going to end up being Comcast/Verizon vs MPAA. We're going to be on the side of the ISP in this case. Ain't that going to be fun?
