Definition of Stalking?

I am taking the don't stalk, abuse, assualt test thingy for college and one thing has made me wonder. It gave a definition of stalking and one descriptor was using public records to gain information about a subject. Is that really stalking if it's public knowledge? It went on to say like going through their garbage to collect info which I would agree is stalking. But I don't know about the public record thing as it's public and exists for that reason

Just keeping this here as a If you ask me, stalking is when you are willfully and repeatedly looking up information about someone, despite them maybe not wanting you to do it.

The key points being "repeatedly" and "the other person maybe not wanting it".

 

If someone was looking and tracking down all my posts on the Internet, following me around when I was out walking, maybe looking into my apartment through the window and so on, then I would definitely say he was stalking me, even though all of those things are "public records".

I guess this really comes down to what you mean by Public Records.

If you just mean googling someone you've met or seeing if they're on Bookface etc then no, that's probably not stalking unless it's part of a larger pattern of behaviour.

 

If, however, you mean record held by public bodies (local government for example) than I'd say that's definitely odd if there isn't a very specific reason for doing so (like you were going to do business with the person and wanted to make sure they are who they said they are). For example, in the UK, if someone was checking the Electoral Register or Companies House records for info on someone without a good reason then I'd say that could definitely be considered stalking.

@BuckGup there is no such thing as stalking in the eyes of Law enforcement in the United States, stalking needs to be related to something such as harassment, for example, if someone openly said that they are stalking @LAwLz on the F_books. In the eyes of the Law, there is nothing wrong with that kind of activity because it would be deemed research using publicly available means. However, if @LAwLz discovers that the attention is not just purely research and they feel that the emphasis is unwanted behaviour, for example, using public records to determine their phone number and checking that the phone is in fact connected at 2 am or waiting for them outside their home to check that, that public record was correct. Then this kind of research becomes unwanted conduct, and individuals have the right to be free from such harassment.

THAT’S THE DIFFERENCE. Just kidding lol. I didn’t get stalking on my tests, we just had “what counts as rape?” 

 

Now that I read your full post, I think stalking is like learning about someone to get close to them without getting the information from them directly & pursuing the information through as many sources as you can. 

 

This means if you like a celebrity, & keep up, you’re a fan as you’re not trying to get close to them. Unless you are then you’re a stalker (like stream snipers stalk their targets in game) 

asking about someone’s kid from their parent isn’t stalking because it’s one source-even if you’re trying to get close it’s not doing everything you can. 

Googling “when are concerts by X band?” Is trying to find out how to get to them but not like doing everything you can to know about them. 

 

Thats just me though. Yeah there are even loopholes in my definition but hey, I’m not a philosopher. I’m drunk and on the Internet. I’m... a drinkosohper?

Yes, because if you're looking for someone or "stalking" them it's for a reason, that reason could be good (find an old friend) or bad (a crime)

yet for the law the answer to that question would be NO, why? because you have to commit the crime first and then justice can use that previous stalking (if they find out) against you to qualify it as a premeditated crime.

It's a really stupid system if you ask me, law should exist to prevent crimes before they're commited, not after, if someone gets killed who cares about the previous stalking, law should catch the criminal WHILE he/she is stalking.

 

the kind of records some companies have about citizens are illegal in certain countries but regular people don't know about this or don't care, a lot of countries have unclear laws about it mainly because these laws date from decades ago and have never been updated, it's kind of a grey area, you can ask the companies to delete your own data and if they don't want to you can take actions against them. a lot of personal info can be roaming through facebook, twitter or other social sites without your consent, pictures mainly but there could be audio recordings or videos, some years ago I had to go through a long process to remove pictures someone took of me from Facebook, lawyers were involved and FB had to hand in the name of the account who uploaded them, then with that I had to initiate actions against the guy instead of FB, it costed but he had to delete the pictures from his account.

sites like "webarchive" also take advantage of outdated laws to store all kind of stuff without people's consent, yes it's also possible to delete personal files from there but again it's a long and tedious process (they expect you to give up on it)

I'd say it depends on intent. If you're just checking their Instagram, Facebook etc. to check what they're doing than I'd say not stalking as they're basically throwing it out there, but if you go to the town office or whatever to see if you can get an address/ phone #, etc than I'd argue that that is stalking
