ISP wants to censor the internet: Canadian edition.

Last year, Bell, Rogers and Vidéotron — all of which are both telecoms and content creators — filed a lawsuit against Canadian dealers who sell "free TV" Android boxes. So far, they've targeted dozens of box dealers.

While Bell may have had Android box dealers in mind when it proposed widened criminal penalties, law professor Geist fears it could have far-reaching effects.

He claims the definition of commercial piracy could be expanded to include regular people who, for instance, share a pirated TV show or movie file.

"The slippery slope is, I think, the reality of how these things unfold," said Geist. "Once you normalize website blocking or normalize the idea that infringement should carry with it jail time and criminal penalties, you open the door to targeting a wide range of activities for potential criminal liability."

 

 

"People are actually leaving the regulated [TV] system, not just because they want to watch Netflix but because they want to watch free content," Rob Malcolmson, Bell's senior VP of regulatory affairs, told federal politicians last week. He was speaking at a government hearing in Ottawa on NAFTA negotiations.

According to Malcolmson, this is how the website-blocking plan would work: an independent agency, such as Canada's broadcast regulator (the CRTC), would create a blacklist of sites that allow people to download or stream pirated content like movies and TV shows.

 

 

Internet service providers, like Bell, would then be required to prevent their customers from accessing the sites.

 

In Canada, copyright holders can sue infringing websites. And some countries, like the U.K., routinely block targeted sites with court approval. But critics of Bell's plan claim it appears to involve no judicial oversight, which means it could lead to rampant internet censorship.

"Engaging in extrajudicial attempts to block access to sites, I think, raises all kinds of Charter of Rights and Freedoms issues," argues Michael Geist, a University of Ottawa professor and internet law expert.

 

Marie Aspiazu, with Vancouver-based internet advocacy group OpenMedia, agrees. "It's radical and its overreaching," she said. "They're going to start blocking any other sites that they don't see fit."

 

The Canadian Wireless Telecommunications Association — of which Bell is a member — is actually challenging the legislation in court

It argues the country's telecom industry falls under federal jurisdiction, and the Quebec law violates the Telecommunications Act by forcing Internet companies to control or influence content.

 

OpenMedia says the legislation, just like Bell's website-blocking proposal, threatens the concept of a free and open internet.
 

 

U.S. says we have a piracy problem

Current NAFTA renegotiations between the U.S., Mexico and Canada will include discussions on intellectual property issues such as copyright infringement.

 

 

On the domestic front, Bell suggested beefed-up copyright enforcement would secure the future success of Canadian content providers by ensuring that they get paid for their work.

 

Besides blocking websites, the telecom recommended that the government direct police to crack down and apply criminal penalties — which could include jail time — to all types of commercial piracy. Bell said that current criminal provisions in the Copyright Act do not necessarily apply to newer forms of digital piracy.

Looks more and more like internet censorship is going to be a thing worldwide soon. ISP's are lobbying for it everywhere in the seems.

 

Privacy is slowly becoming a thing of the past. 

 

All this to not really stop Pirates.

I find it really funny that the govt isn't focusing on it, but the big corps are. I guess it's cause all of these companies also produce content that gets pirated.

 

After the lobbying works (it always does), they'll look to block VPNs since they potentially allow access to the pirated content that is normally blocked.

The whole problem is that these sites are just going to become more underground, and can really never be stopped,  not by some "impossible to enforce" laws, as VPNs would still be able to access them

It's interesting how the argument of a small group of people using the internet for bad things means it should be banned doesn't apply to all the other things that meet the same criteria. 

 

We have a government in the UK that wants to ban end to end encryption, which will ultimately just result in people doing bad things taking encryption into their own hands (not that they're not already doing that) and all of your average, law abiding users will just be more vulnerable. 

 

They're using this awful technology that allows bad people to talk to each other in secrecy. It also just happens to stop the government from being able to easily snoop in on you and gather up all the data they can.

I do not like piracy. But if this continues they will be restricting access to websites. You want to open facebook pay 1 cent for 1 access LOL it's funny.

I do not download any pirated OS or program/games. I use arch linux and strictly FOSS (Free and Open Source Software) If available i even use free drivers for my devices, but i like watching movies. That's the only problem i have. I can't stop watching them also i can't afford buying every film i watch. You know average salary in my 3rd world country is ~130 $. Maybe it's wrong but if i will find a way i will watch them for free. If/When i will have enough salary i will pay for it, until then i'll just continue watching them

The expectation is that things like VPNs would eventually be banned, once companies and more so, governments, realise the laws can just be bypassed. It's ultimately what happens when you have people making legislation based on just what they want to achieve and don't actually understand the technology behind it. 

 

The UK's government is trying to ban encryption, making it out to be this terrible tool used by terrorists and child molesters (because no one wants to argue against that kind of thing) to do bad things, despite the overwhelming amount of positive uses for it. You often see politicians saying they either want it banned or they want it so that only the government can break it whenever they want to. Thing is, we obviously can't trust government agencies to keep their own data safe, given how the CIA and NSA have both been hacked multiple times with massive data breaches. As soon as the encryption backdoors get stolen or leaked, encryption becomes useless.

The reversal of Net Neutrality has already made that possible, unfortunately. It took ages to get it passed but then it was overturned so easily, it sucks.

How would that be at all a 'Problem' to copyright holders?  Do you think the objective is to eliminate piracy 100%?  No one thinks that's possible.  Their entire objective IS to drive it more underground.  Right how this kind of media piracy is literally idiot proof.  Sellers online effectively offer 'Magic Boxes' that make TV happen when you plug them into the wall.  There is no skill barrier to entry.  Literally any idiot of nearly any skill level can buy said 'Magic Box', plug it in, and boom.  Free, unlimited streaming TV happens.  By driving that underground, by increasing the barrier to entry, you decrease the piracy.

In a couple of decades people will read of this wonderful and glorious worldwide open communication system known as the internet and how each government came up with it's own set of rules on how it should be managed.  This led to the time when this communication network was cut up and mangled to appropriately match each governments requirement and the dark times when people lost the ability to communicate across borders and the death of the internet...  Of course this would be assuming that said governments would allow that story to be told.

Thoughts on this, I don't want Canada to be like China or whatever is left of the UK regarding censorship. Telecom companies with services that offer tv/cable to me doesn't make sense to pay for a service with ads on them, and yes I know that that is how the companies generate revenue. The telecom companies have to adapt or have their services reduce because of external influences. When they do drive these groups underground, they will always try to find a way to get back in the game of distributing these boxes.

And of course, Quebec is quebec preaching their gospels on regulations of contests and gambling.

It has always struck me as odd that the US government both created initially and continues to help fund the Tor project yet proposes legislation that is unenforcible if said project continues to exist, anyway eventually we'll need to physically destroy isp's since clearly they've paid off too many people to remove them via the "legal" process at this point.

This being done per ISP basis with no oversight is a bad thing. What about if some random guy on a random forum uploads pirated content and the ISP takes the entire site down? What if the site just links to pirated content? Not against something being done about pirated content in the least bit though. It's rampant over here to the point where I get funny looks if I say I don't pirate. People just talk about pirating very casually and I even know millionaires who do it.

It always baffles me that these companies seem to think they can actually do anything about piracy by trying to take the options away. Don't they understand that as you remove one option, two others become available? Rather than trying to block or take down piracy websites, maybe ask yourselves why people are using those websites in the first place, then come up with viable solutions for people to access the content they want legally. Almost every illegitimate website I've seen has a much more robust feature set with higher quality control, consistency, and ease of use than their legal alternatives. I don't live in Canada, but I still sincerely hope this doesn't become a reality - once other countries see that they can get away with it, they will - it sets a very ugly precedent.

 

And that's just why the basis of their argument is stupid - let alone the fact that asking the government to force ISPs to blanket-ban any potential piracy hot-spots opens up a whole other can of worms, not the least of which being that "What constitutes a piracy website?" becomes a serious question and exactly how dangerously thin that definition may become (maybe a website that shares video of governments committing war crimes becomes "piracy", not entirely likely, but possible nonetheless, and the precedent would exist).
