BOSE used their smartphone app to spy on customers - lawsuit claims

Bose Corp spies on its wireless headphone customers by using an app that tracks the music, podcasts and other audio they listen to, and violates their privacy rights by selling the information without permission, a lawsuit charged.

The complaint filed on Tuesday by Kyle Zak in federal court in Chicago seeks an injunction to stop Bose's "wholesale disregard" for the privacy of customers who download its free Bose Connect app from Apple Inc or Google Play stores to their smartphones.

"People should be uncomfortable with it," Christopher Dore, a lawyer representing Zak, said in an interview. "People put headphones on their head because they think it's private, but they can be giving out information they don't want to share."

Bose did not respond on Wednesday to requests for comment on the proposed class action case. The Framingham, Massachusetts-based company has said annual sales top $3.5 billion.

Zak's lawsuit was the latest to accuse companies of trying to boost profit by quietly amassing customer information, and then selling it or using it to solicit more business.

After paying $350 for his QuietComfort 35 headphones, Zak said he took Bose's suggestion to "get the most out of your headphones" by downloading its app, and providing his name, email address and headphone serial number in the process.

But the Illinois resident said he was surprised to learn that Bose sent "all available media information" from his smartphone to third parties such as Segment.io, whose website promises to collect customer data and "send it anywhere."

 

what the actual fuck BOSE!? you sell headphones for 350$ and it's not enough? you also have to sell the info the app collects to 3rd parties?!

Not surprised in the least to be honest. Just yet another company to add to the spy list.

If you need an app/software to use a hardware product, and said app/software connects to the internet, it's probably spying on you. Those smart lights you got? Most likely spying on you, to know at what time you're home, etc... which in turn they can sell to advertisers so they know which time precisely you're more likely to see their ads...

In my opinion, I feel as though this is no different than almost any other app. They don't force you to utilize the app to operate the headphones, they just recomend it for "a better experience." I don't know for sure, but I'll bet there was some sort of terms of service agreement that acknowledges the use of tendency data.

I have the app and I was wondering why it needed location although I don't really use the app that much since all you can really do with it is change the name of your device and use a second volume rocker. At least that's how it is for my Soundsports.

If you are going for sound quality sure. They don't market them as strictly great sound quality they are more focused on Noise cancelation. It's why they promote usage while flying so much. People are the ones who started spreading the sound quality aspect due to their OEM and home theater/remote speaker products.

 

They are one of the largest headset manufacturers for pilots for that very reason.

Are you kidding, everything should have flashing lights and large bold print with a voice reading to you out loud and make a agreement for every sentence so people have the option to agree to only parts.

Last time I checked, it was only cigarettes, gambling and alcohol that had that. I don't think companies are obligated to do that even at a PR cost.
