A court ruled it is now a federal crime to share passwords for video-streaming services like Netflix and HBOGo.

The U.S. Ninth Circuit Court of Appeals issued an opinion last week, which found that exchanging personal account information falls under the Computer Fraud and Abuse Act (CFAA).

 

The discrepancy was finally settled during the United States v. Nosal trial, according to Fortune Magazine Sunday. David Nosal was an employee at an executive search firm called Korn/Ferry International before he left to create a competing company with several other people in the industry. Nosal and others parsed through Korn/Ferry’s database to grab prospective candidates, even though they were not given authorization. He still continued to use the system through his former assistant’s login credentials.

 

“The circumstances here–former employees whose computer access was categorically revoked and who surreptitiously accessed data owned by their former employer–bears little resemblance to asking a spouse to log into an email account to print a boarding pass,” the judge wrote in the majority opinion. Judges in other, potentially more complex cases, will decide if this ruling encompasses all instances of password sharing.

Stephen Reinhardt, another judge in the Ninth Circuit, drafted the dissenting opinion and stressed that this ruling “loses sight of the anti-hacking purpose of the CFAA, and despite our warning, threatens to criminalize all sorts of innocuous conduct engaged in daily ordinary citizens.” In other words, this ruling turns everyone into “unwitting federal criminals.”

 

The need to make this law so expansive also came into question when Aaron Swartz, a young programmer, committed suicide in 2013 after he was criminally charged for obtaining research papers from an MIT database. This technically violated the institution’s terms of service, even though he was a research fellow with official access to the database at the time.

 

The inherent difficulty of fairly and equally applying this law has caused sometech experts to call it one of the worst laws in technology.

Depending on what type of subscription a person gets, many video-streaming services, like Netflix, allows multiple devices and users from different locations to simultaneously view content under one account.

I honestly cannot believe that this is happening. We REALLY need to elect a "nerd" majority to congress, and get some of these laws fixed. They're outdated, written by people with no technical knowledge (and corporate backing) and they just don't work correctly.

Yeah like that will stop anything. Boohoo Netflix you still have a paying customer at the end of the day.

And if I remember correctly, Netflix, and possibly other subscription based streaming services actually allow for you to connect with a certain number of devices simultaneously, as apart of the subscription. So this is an extension of that story from last week were they thought that office passwords and that would fall under the law but things like netflix wouldn't?  Glad they cleared that up /s

Hold on, as far as I can tell, this post actually does bring new information.  When the original story broke, there was some ambiguity as to what would fall under this new law, and on WAN show, they postulated that things like work passwords would, but personal stuff like netflix would not.  Now you are saying with absolute clarity that they in fact do.

To me, this just screams of old folks not understanding technology as usual and banning everything.

Then, by my understanding of the way our laws work, Netflix, and a few other companies, are possibly allowing you to violate the law, which would put them in violation of the law?

Well I think it means in that scenario they authorized it, however this is so vague I can't say for certain I'm right about this.

But that's not sharing a password, strictly speaking :D 

It's like installing another door in your house with its own key, rather than sharing the existing key with the other person.

If the description by @AresKrieger is accurate - that one account can have multiple users associated with it, each of them with their own unique login credentials - it should avoid this sharing law entirely.  In every case, one person is logging in with the password that only they know and use. The fact that it's a shared account would be irrelevant.  Furthermore, the whole question of who is "authorizing" use of the password is settled by the fact that, A, the primary account owner would have to authorize additional users, and B, netflix inherently authorizes this issue of their systems by offering the method.

It still feels like a re-toast but now they're clarifying that it does in fact apply to even non-work related stuffs like Netflix. Well let's hope that Netflix maintains their acceptance of account sharing. Because this law applying to ordinary people not sharing work passwords is BS.

It doesn't matter (entirely) what Netflix or any random corporation allows, if "account sharing" is against the law, they have to stop allowing it, and prevent people from doing it, or they are "aiding and abetting"
