If the laptop was sold / advertised as coming with a Windows license, you should contact the seller - they are responsible for ensuring the item you purchased works as it was described. If it was sold without a Windows license, then you need to purchase one.

On modern PC's and laptops, the product key is embedded into the BIOS and isn't provided on a physical sticker attaches to the device.

 

If the install of windows provided isn't activated then the seller has either installed the incorrect version of windows or the device originally never had a license key in its BIOS, meaning that you'd either have to purchase a license to activate it or you're going to have to go back to the seller about it if it was advertised as having a windows license.

They are offering me $40 back. Should I take it despite the advertised Windows 11 Home?

That depends on whether or not you're willing to pay the difference to purchase a Windows 11 license for the laptop, assuming you want to run Windows on it. In Canadian munnies, getting $40 back means I'd still be out $149 for a Windows 11 Home license.
