Issue with new NVIDIA app

Hoping someone here can assist me with a issue i seem to be having when using the new NVIDIA app

The issue:
When i have the overlay turned on, when i tab out of a game my windows start-bar seems to go behind the game, for example if i tab out of a game to a browser my browser window stays on screen but after like 1/2seconds the start-bar disappears and where it should be i can see the game. while the rest of the screen is still my browser, This is 100% caused by the new NVIDIA app as with geforce experience it does not happen and works perfectly.

While i know turning off the overlay can fix this its not exactly a great solution.

Anyone else having this issue and or a fix?

Do you use the game in fullscreen or borderless?

99% of the game i play are in Fullscreen but i have tried all three

Full Screen,

Boarderless Window
Windowed

All give the same result,  The start bar disappears after +-2 seconds
