Looking for video where it is explained that non-partenered companies cannot resell preinstalled windows legally

Does anybody remember in what video explained that a company cannot just buy laptops with windows installed, maybe put some of their own software on it, and resell the laptop again? Because the user does not agree to the Windows EULA and the company probably even violates some other things too.

I think is was slightly off topic in the video and that is why I cant find it back.

Im trying to find the video to get the exact wording they used, but any other legal info about this is also welcome.

The installation of Windows isn't the issue, nor is it a licensing one, but companies shouldn't pre-configuring Windows for users and skipping the setup process (where one agrees to the ToS & EULA). With Microsoft accounts being required for set up this has become less of a situation with Windows 10 and 11. It was far more common in the XP, Vista era. 

 

That said, companies can absolutely add their own software to the windows image as long as they maintain the setup process. This is essentially required for most drivers and software that comes bundled with machines.

Thanks for the clarification @Skipple!
In my case the question is specifically about laptops being sold with preinstalled windows and even including an user the buyer has to use, to use the included software.
I don't think there is a setup process for the end user anymore, but I will check that to be sure.

Yes if there's a preconfigured user on the machine, it's almost certainly an issue.

 

Now the question is does Microsoft care enough to go after this particular manufacturer? If they're doing this they're probably not a large manufacturer therefore more than likely MS doesn't give a care.
