In a groundbreaking initiative announced by the Department of Justice this week, federal contractors will be sued if they fail to report a cyber attack or data breaches. The newly introduced "Civil Cyber-Fraud Initiative" will leverage the existing False Claims Act to pursue contractors and grant recipients involved in what the DOJ calls "cybersecurity fraud." Usually, the False Claims Act is used by the government to tackle civil lawsuits over false claims made in relation to federal funds and property connected with government programs.

For too long, companies have chosen silence under the mistaken belief that it is less risky to hide a breach than to bring it forward and to report it,” said Deputy Attorney General Lisa O. Monaco, who is pioneering the initiative. "Well, that changes today. We are announcing today that we will use our civil enforcement tools to pursue companies, those who are government contractors who receive federal funds, when they fail to follow required cybersecurity standards—because we know that puts all of us at risk. This is a tool that we have to ensure that taxpayer dollars are used appropriately and guard the public fisc and public trust."

The development comes at a time when cyberattacks are rampant and advanced ransomware gangs repeatedly target critical infrastructures, such as the Colonial Pipeline and health care facilities.

"The act includes a unique whistleblower provision, which allows private parties to assist the government in identifying and pursuing fraudulent conduct and to share in any recovery and protects whistleblowers who bring these violations and failures from retaliation," explained the DOJ in a press release.

The initiative will hold entities, such as federal contractors or individuals, accountable when they put US cyber infrastructure at risk by knowingly "providing deficient cybersecurity products or services, knowingly misrepresenting their cybersecurity practices or protocols, or knowingly violating obligations to monitor and report cybersecurity incidents and breaches."

 

My thoughts

Well, imo, FINALLY. This is something that should've been done quite sometime ago. However, this applies, for the time being, solely to federal contrators and government agencies. I feel like this should be extended (through legislation) to ALL companies registered in the US. But otherwise, in light of recent breaches and the havoc and damage they've caused, this is great. I hope other countries start to persue such legislation as well.

Honestly, this should apply to any business entity with an online presence.

Grammar and spelling is not indicative of intelligence/knowledge.  Not having the same opinion does not always mean lack of understanding.

Depending on what data is breached it already is, at least in many countries. Problem is if the company never discloses a data breach then who's to know? Not everyone wants that hassle of going the whistle blower route, especially as tricky as something like this.

If it is not reasonably practicable to notify an affected individual or each member of a group of affected individuals, an agency can give a public notice of the breach.

GDPR also has these breach notification requirements, from what I can tell US is behind on this one not in front. Above link you can change the drop down to check any country btw.

 

Like every non giant country, holding these large corporations to account for breaches is next to impossible. Our laws do apply to Facebook, Google etc but we've never tried going after them for anything far as I know because it's an impossible task.

Did I miss a joke? 🤷

 

I'm not sure these two things are even related. I've never heard anyone try to defend a non disclosure event with "their platform, their rules" and if anybody ever has, they have some logic understanding failure going on.

 

This argument only makes any sense when applied to removal of posts or "censorship" (in quotes because its not really censorship).

 

In a non disclosure scenario the major relevant factor is the erosion of customer safety.

Have you seen the US congress? Senior Citizens dont like change and considering they run this country. Thats why it wasnt a thing. Frankly most of them dont understand the Internet or computers for that matter.

We already have some form of compensation for whistleblowers that occur when their tip results in fines above a million dollars. 
 

How about this gets applied to concealed data breaches as well? Try to conceal a breach, now each of your employees in the know has a strong financial incentive to turn on you.

I also drive a volvo as one does being norwegian haha, a volvo v70 d3 from 2016.

Reliability was a key thing and its my second car, working pretty well for its 6 years age xD

This argument only makes any sense when applied to removal of posts or "censorship" (in quotes because its not really censorship).

 

In a non disclosure scenario the major relevant factor is the erosion of customer safety.

 

Oh they are related,  it's not really a joke but a reflection on the stupidity of the human race to defend things that are actually not good for them.  Especially with regard to corporate responsibilities etc.    An example would be the people who argue it's googles platform so they should be allowed to collect your data without telling you, or it's apples platform so they should be allowed to hide security related issues to make it "safer".
