Is my Brother's new IPhone 12 Pro fake?

There's No (CE) Mark on the sides.

The EMUI codes are right and all the other specs too.

There's also that circular black spot in the first photo on the side that isn't on the online photos.

It has IOS, doesn't look like a fake OS since all the apps are there and you can really see the camera quality is good.

But we're worried because there's no CE Mark and that black spot in the first photo that doesn't appear on the online photos.

Iphone 12 pro's have the black thing on the side i dont know what it is but they do have it and some models dont have the CE thing

You won’t see regulatory markings on a non EU/UK iPhone.

Apple puts the regulatory labels on a software page unless absolutely required to be on the outside in the region it's sold in.

Check warranty status with the serial on apple.com if you want to be sure...

The regulatory markings aren't necessary in most places anymore, and that spot is completely normal - it's for the 5G antenna. It's in all the photos of the phone online.

We're from Europe and at this point i just think the phone was manufactured for America, etc, since there's no CE.

Then likely used/imported model. 

That's kinda important to mention when you ask for comments, people will assume bought new straight from Apple.

Ah, in which case, I'm not sure if I'd worry (disclaimer: I haven't bought an iPhone since my XS, so they may have changed things without my knowing). It's just a bit odd as the iPhone 12 already has an eSIM for people who don't want or need a card.
