Whats in the dropdown list where it says 2133Mhz DDR3??? Do you have a 2400Mhz option in there?

(Even setting XMP to 2400Mhz, the board is set to 2133 Right there on that first image)
If thats the Max, that's the Max that board supports (maybe try updating the board to latest if not already as they usually up the RAM compatibilities)

If available, set that 2133 to 2400 and reboot.

If you can ONLY get 2133, you can try changing the 11 13 13 (2400Mhz) timings to 10 11 11 at (2133Mhz) to get "most of the most out of them".

Maximums - Asus Z97-K /w i5 4690 Bclk @106.9Mhz * x39 = 4.17Ghz, 8GB of 2600Mhz DDR3,.. Gigabyte GTX970 G1-Gaming @ 1550Mhz

Motherboard bios are up to date and the board does support 2400 that drop down menu shows 2400 but when i check it the bios tries to apply the overclock but fails so im thinking its voltage issue.

1.65v is all it needs (RAM) so it's likely your 2600K has not got the good enough memory controller to run 2400Mhz,... and only 2133Mhz (silicon lottery on Ram support using Older processors)

Hmm might be right so think the 3770k will run the 2400 clock just fine?

Should be, its actually impressive it got that fast in the first place. Officially it technically supported 1333Mhz (as in the 2600k the 3770k is actually advertised to support 2400Mhz)

Ok thank you guys for all your help just trying to Squeeze as much power as I can out of this system because I don't wanna do full new pc till later think I'm waiting till ddr5 ram honestly and this was my first pc build kind of like a project for me at this point to finish it after all the upgrades over the years and it plays pretty much anything fine but yeah the 3770k will probably be the last upgrade was thinking about a rtx 3060 as a last upgrade but I doubt I will be able to get a pre order for the card because scalpers and miners ruin everything lol.

Yeah DDR5 should be coming like Q3/Q4 of this year but honestly I doubt we will see much adoption or supplies till 2022.

Yeah I expect DDR5 to be the normal for ram by late 2022 early 2023 hopefully.
