Summary

Youtube-DL and all it's forks have been taken down from GitHub by DMCA takedown notice from Recording Industry Association of America.

The clear purpose of this source code is to (i) circumvent the technological protection measures used by authorized streaming services such as YouTube, and (ii) reproduce and distribute music videos and sound recordings owned by our member companies without authorization for such use. We note that the source code is described on GitHub as “a command-line program to download videos from YouTube.com and a few more sites.”1

We also note that the source code prominently includes as sample uses of the source code the downloading of copies of our members’ copyrighted sound recordings and music videos, as noted in Exhibit A hereto. For example, as shown on Exhibit A, the source code expressly suggests its use to copy and/or distribute the following copyrighted works owned by our member companies:

• Icona Pop – I Love It (feat. Charli XCX) [Official Video], owned by Warner Music Group
• Justin Timberlake – Tunnel Vision (Explicit), owned by Sony Music Group
• Taylor Swift – Shake it Off, owned/exclusively licensed by Universal Music Group

 

The source code notes that the Icona Pop work identified above is under the YouTube Standard license, which expressly restricts access to copyrighted works only for streaming on YouTube and prohibits their further reproduction or distribution without consent of the copyright owner; that the Justin Timberlake work identified above is under an additional age protection identifier; and that the request for the Taylor Swift work identified above is to obtain, without authorization of the copyright owner or YouTube, an M4A audio file from the audiovisual work in question.

We have a good faith belief that this activity is not authorized by the copyright owner, its agent, or the law. We assert that the information in this notification is accurate, based upon the data available to us.

Anticircumvention Violation. We also note that the provision or trafficking of the source code violates 17 USC §§1201(a)(2) and 1201(b)(1). The source code is a technology primarily designed or produced for the purpose of, and marketed for, circumventing a technological measure that effectively controls access to copyrighted sound recordings on YouTube, including copyrighted sound recordings owned by our members. For further context, please see the attached court decision from the Hamburg Regional Court that describes the technological measure at issue (known as YouTube’s “rolling cipher”), and the court’s determination that the technology employed by YouTube is an effective technical measure within the meaning of EU

 

My thoughts

I'm not surprised that this has happened as I have been surprised several times just how powerful Youtube-DL is.

I think it's kinda stupid to show stuff like music videos as examples as for example RPCS3 has received DMCA takedown because they mentioned Persona 5. However I believe that this is abuse of DMCA as Youtube-DL is 100% original work.

Oh look I can find four more youtube downloaders on GitHub now Hail Hydra. I really don't understand how people can get into high enough positions to have jurisdiction to do something like this yet act excited when the airplane is coming to deliver their formula into their mouths.

Just keeping this here as a Well, that sucks...

 

And (obligatory "I'm not a lawyer") it seems like a blatant misuse of the intent of DCMA (as bad as it is) to prevent a legitimate tool from existing that can be used to "illegally" download something. I can use Windows to make copies of copyrighted files, why is Windows legal?

 

I feel like there needs to be a provision in DCMA that for any claim filed, the defendant needs automatic free representation to prevent huge corporations for whacking one-man-bands with lawsuits that they can't hope to afford to counter.

I think this is very bad if the program has uses that are lawful. You can't ban every program that can be used for illegal activities otherwise you run into alot of issues. Them doing a DMCA takedown is actually ridiculous.

Keeping/copying content for which you have a license for personal backup has been something that has been determined to be legal (at least in context of ripping CDs/DVDs/BDs). I don't see a reason why that shouldn't apply to streaming media. If Youtube actually cared, it very well could be DRM'd, which confuses me every time they try to say that downloading YT videos is against their terms...

I think they can also claim against material that can be used to access copyrighted content without going through the "proper channels". Which is kinda BS for an agnostic tool like YTDL (it had a lot of other applications besides downloading YT videos).

Yeah, the media company only requested the takedown because the tool can potentially be used for copyright infringement, which is an even more dangerous precedent.

Doing a little more reading at YCombintor, it sounds like they pulled the entire project down because of examples in the documentation.

 

Somehow I don't think that removing the examples are going to placate the RIAA, though. Remember folks, don't document your code or you might incite the wrath of the recording gods. #BrokenAesop

Oh, maybe it's because it wasn't digital, the DMCA didn't exist, and mainly because it never happened.

 

Still, taking it down from GitHub is just petty. It won't stop it from being legally distributed and used but whoever wants to by a number of other means.

 

 

(the other aspect of my facetious analogy is that this is software - which is why it happened, but also why it shouldn't: whatever the infinitely reaching hand of the DMCA currently says, the only way copyright claims should apply to software is if you use someone else's, non-GPL code. You shouldn't be able to DMCA software "because it has bad intentions". Malware isn't copyright infringement, so no matter how criminal your software is, it should not be DMCA material unless it's also plagiarized.)

The complaint points out that the source code expressly suggests downloading/copying specific copyrighted work. IANAL, but that seems pretty significant and is a pretty good justification for the complaint.
