There is a difference between a physical product that you film to footage of someone's else featuring the physical product.

That's completely different, it's using someone else's footage instead of shooting yours that matters. The copyright discussed here is on the footage. The work of doing the research and shooting the piece of content has a cost, and the author has a right to decide whether it may be used or not and in what conditions.

What I mean is, the YT copyright claims is built around the Digital Millennium Copyright Act, so featuring a GPU, either showing it by itself, or in a PC while "at work" isn't protected by the Digital Millennium Copyright Act, but firmware hacking is.

 

So it's totally possible that nVidia, Intel or AMD would take a video down using the YT copyright claims, it wouldn't be because of the YTber showing the video car, or CPU by itself ... not sure if that makes sense?

No, it definitely shouldn’t. You can’t just make a blanket statement like that, it should be a case by case discussion, not how long the copyrighted material you used is compared to how long your video is. You still need to make a compelling case that your use of the material falls under fair use.

I can no longer see the comment that was pinned by AdoredTV on the youtube video. It appears that he has removed it. No update to let people know what happened though... (yet, at least)

 

Speaking of misleading, after acknowledging that LTT has retracted the claim, AdoredTV is posting on Twitter making claims that LTT stole the money for his hard work. That's false as any ad revenue claimed through copyright claims is held by Youtube, and as the claim has been removed the funds will be directed back to AdoredTV - Something that any professional Youtuber would be well aware of.

my reply to him was the least most rude thing i've tweeted, i even provided evidence as to why he was wrong, i don't know how correcting someone and updating them about the new information is unnecessary. but i digress, that's irrelevant to the discussion.
