You wouldn't download a Manga would you? - Japan tightens manga piracy laws

Piracy of books online, such as Manga has been an issue that has avoided most piracy laws for years. In Japan this might change soon.

The Diet on Friday enacted a revised anti-online piracy law to tighten copyright control, banning illicit downloading of manga, magazines and academic texts, in addition to music and videos that were already covered by the existing legislation. The law also regulates “leech websites” that provide users hyperlinks to download so-called torrent files of pirated materials. The ban on illegal downloading will take effect on Jan. 1 next year, while restrictions on leech sites will come into effect on Oct. 1.

The law revision came as the country saw a rising number of piracy and leech websites, notably the Mangamura site, which had over 100 million hits a month before being disabled in April 2018, causing an estimated loss of more than ¥300 billion ($2.75 billion) to publishers. The Agency for Cultural Affairs lists examples that can be exempted, such as downloading only a few frames from a comic book of several dozen pages and a couple of pages from a novel containing several hundred pages. Parodies or derivative works are also exempt, as well as cases where smartphone users unintentionally captured copyrighted publications in their screenshots. As for illegal downloading, penalties for repeat offenders will be up to two years in jail or a maximum fine of ¥2 million, or both.

 

Loopholes remain, however, as videos showing copyrighted items in the form of a picture-story show or provision of such materials through streaming — as was the case with Mangamura — are not covered by the revised law as they do not involve downloading data to devices. Also, many piracy site operators use servers overseas where rules are lax. So-called bulletproof hosting services that are lenient about what can be hosted on their servers and warrant high confidentiality hinder requests for information disclosure. A site-blocking measure to forcibly deny access to certain websites is also difficult to implement in Japan, as it requires subscribers’ access data and could violate the privacy of communication.

Thoughts: While tackling literature piracy in their own country may be easy, the majority of "free online Manga" is still hosted around the world on sites such as mangadex (which had legal troubles recently), kissmanga or torrents. Would it cause financial losses to prosecute these sites or would it help sales?

To be quite honest, I totally would, if I knew of any good ones to download. (I'm not a weeb and I can't stand anime, so I'm completely, entirely unaware of what is or isn't available and/or good)

 

Piracy is one of those things where I am firmly on both sides of the fence; I just simply cannot afford to pay for everything, it's a literal impossibility, so no one is losing out on my money if pirate something that I wouldn't be paying for anyways. On the other hand, I still do at least attempt to pay for many things, even if I know full well how to pirate the stuff.

Yeah I don't agree with the argument that they "lost sales of x billion" as I don't think many illegal downloaders would pay for them if they were unable to download them anyway.

 

I'm not condoning piracy, but I'm also not in the camp that believes it is "theft". Hell, some  people that aren't techno-literate still think "downloading" equals piracy, they don't understand that you can legally download something 🤣

Think Manga might have to jump to the subscription model (ala Netflix for Manga) if companies really want to clamp down on Piracy. 
 

People tend to take the path of least resistance, and pricing Manga at $10 (or w/e that is in Yen) provides a lot of resistance.

Most people pirate things to try out the full version with their setup, read the full story, listen to the full song, etc. If they like it/it works, they will delete the pirated content and buy the full version. Or if it's not available for purchase in their region, they might donate to the studio or buy merch. That said, I don't care about big companies, like Disney. They can afford millions of pirates per year without even noticing a loss in profits. But a small indie company will see a significant loss. As such, I try to only pirate content that is not indie. When it comes to college text books, I've only ever paid for three :)

 

But to be frank, this will not stop or even hinder piracy of manga at all. If anything, this news about it helps more people to learn that they can in fact get something for free. So more people are likely to try and pirate. As long as you have a good vpn (like Nord or PIA) and you use your head, you can pirate whatever your hard drive desires. The war on piracy is a bootless errand. Once one person has it, everyone has it. There's no stopping piracy short of globally banning vpns and monitoring all traffic at all times (which is literally impossible).

They still refuse to learn. You cant stop piracy no matter what you do, anyone who thinks otherwise is living in a dreamworld. It is possible to reduce its popularity but you need to change in accordance with the change of the users preferences. One central subscription, no BS DRM*, etc.....

 

(*wont argue about this, no DRM is capable of preventing piracy, period)

Japan actually makes it very difficult on purpose to move there. They try to keep many foreigners from moving there and buying lots of land

How about making them more accessible? Make a nationalized catalog where the purchase can be made internationally with all profits going directly to the creator. It really isn't difficult. I don't need a paper copy, though I would prefer one, but consolidation of all volumes would be much better than fragmentation of the marketplace. 

 

Also, Nintendo and others need to stop their f#cking crusade on piracy. It solves nothing and only instigates worse outcomes when the actual solution is much easier.

As an American, I agree with this approach. Japan has its own set of problems, but I miss the 16bit days and first gen 32bit consoles such as the PS1, Sega Saturn, and Dreamcast. After that, pretty much went down hill IMHO. Don't get me wrong, there's some fantastic games out there, or I wouldn't be gaming myself. But, can't put my finger on it, but the culture has changed a lot and I'm not sure its for the better. I must be getting older and that's that.

Isn't Crunchyroll for Japanese stuff like manga/anime and works like Netflix? I haven't used it myself but have seen ad for it on AngryJoe and if you're into this stuff, the sub is affordable imo. And they apparently add subtitles really fast. A lot of stuff is so convenient these days that I can't be bothered to deal with pirated stuff. Unless people releasing it are total assholes with DRM, pricing schemes or I'm just looking for something so rare it's difficult to find it even on P2P. Then I'll use any means possible. But if there is an easy way for a fee that's not absurd, I'll always pick that. I stopped pirating games when Steam launched years ago. I didn't have credit card back then, but I found cool people who only knew me on the local forum and they bought it for me and I wired the money via bank which i visited in person coz no credit cards. After few years I got my own credit card and since then it's been the easiest shopping ever.

This. But some just don't seem to get it. Music industry is particularly shit at self awareness. And movie industry isn't far behind. There is bunch of garbage services that either have poor selection or there is something like iTunes which gives you limited options. Movie industry isn't any different. I'd watch tons of brand new movies as they hit theaters. If I could stream them to my home the moment they are released. I'd literally PAY for it. Yet that's just not even possible. Netflix? Sure, it's good and has ok content. Until you realize how monumentally they are screwing us with amount of content available to us Europeans. Of course they don't mention this anywhere, at all. Until American users tell us how much more content they have compared to us. And then whole movie industry is like retarded pikachu when you pirate something because they are apparently too dumb to sell it to you.

 

Steam doesn't seem to have that problem. There is very little content that is region limited. So, if it's released, you'll find it on Steam. And I'm gonna buy it before I'd ever pirate it if it's easily accessible, convenient and works. And it works so well I can't be bothered digging around for cracks even if that means I could play the game absolutely free. Now, when you reach that level, you're doing something right. Which still can't be said for movie industry particularly where I'm rather just wait for a rip because I just hate going to cinemas and there is no alternative for that. I sure as hell am not going to buy DVD's or BluRay's for movies. On average I watch movie maybe twice if it's really good, but mostly just once and that's it. Unlike games that I often play many many times because content is different on every play. And even there, stockpiling physical mediums is annoying as space is limited. Steam library is limitless. Or GOG library if you don't like DRM...

I just cracked a SteamVR driver as the trial of 10 minutes is awfully short. By the time you've launched the software (starting the countdown), connected Bluetooth devices, setup SteamVR and launched a game, you have a couple of minutes to try and work out why it's not working before it quits. The best part is it monitors how long the SteamVR process has been running, so you need to restart everything. The trial to see if it works literally doesn't let you see if it works.

I wanted some high quality files of 2 albums, ended up being easier to buy the CD's and rip them myself to get what I wanted and probably less expensive than paying for a lossless music streaming service or trying to find them online in lossless.

Usually if it’s good I don’t pirate it, or if it’s a multiplayer game I don’t pirate it either. Even prefer to buy on sale. 
 

if it’s not on sale, to expensive or simply not worth it, it’s going to get downloaded. Make a good enough product and people will pay for it.
