Apple fined for misleading customers with faulty iPhones and iPads

After a recent ACCC investigation into customer complaints stemming from "error 53" messages they received after an iOS update, Apple had a $9 million fine handed down a Federal Court. This after Apple admitted to misleading at least 275 customers as to their eligibility for repair. According to the ACCC

"If a product is faulty, customers are legally entitled to a repair or a replacement under the Australian Consumer Law, and sometimes even a refund," ACCC Commissioner Sarah Court said.

 

The court found that the company did not have the right to deny service even if the customer had the device previously repaired by a third party. Further, the ACCC Commissioner clearly pointed out that if the device is faulty and the customer would like a new device or a full refund, they are entitled to demand such from Apple rather than a refurbished device.

A great incentive to not screw up as you might have to replace the device with a newer better model because of your screw up.

This is so silly. 

 

So if i break my iPhone, get it fixed by a third-party who does a really bad job, it's Apple's fault, not even that but i'm entitles to a brand new one, instead of one thats been fixed properly and in great condition.

I think the key here was the fact that the repairs were done by a 3rd party that was not Apple. Though when you don't make a way for 3rd parties to do so in an authorized manner, you create your own problem.

Even as a last resort you can send in your phone directly to your nearest Apple Store. Keep in mind in this sense the third party repairers are not authorised nor using Apple manufactured parts - screens or TouchIDs, seeing as your fingerprint is stored in the sensor, you want to keep it with Apple parts, especially if you phone is stolen, then hackers can potentially swap out a TouchID sensor and unlock the phone, that's why the error occurred (and also in bugs). I wouldn't go anywhere that didn't supply genuine Apple parts.

And how does that help in places that don't have them ? It's not rocket science to repair their phones compared to a samsung, lg or google. Why are they making so hard for people to get repairs ?

Keep in mind in this sense the third party repairers are not authorised nor using Apple manufactured parts -

but this is the crux of the issue. Apple don't want to authorize third parties repair stores to repair their devices for what ever reason.

 

I live in a city with a population of 120,000 people and there is not authorized apple repair centre anywhere near here. most people are going to search "iphone repair <city name>" or just go to a place they know repair smart phones because the average consumer is not going to know about these issues and that apple can brick their phone because it was not repaired by an authorized repair centre.

Anyway. I'm amazed at the hoops apple make people jump through just to use their product. I bought my android phone 4 years ago...... and that was it. Didn't have to make any accounts , or download updates or anything , just worked and still does. while my sister has been through like 3 iphones in the same time period.

honestly i think i've only ever heard people complain about the iphone , i don't think i've ever seen someone who had a very old iphone that worked well and needed nothing since purchase.
