is putting an xbox one game in a computer and then playing it illegal?

I'm uncertain, but most the games are most likely blocked by their DRM - so you'd have trouble playing them without an emulator (which I'm pretty sure is against XBox's rules).

probably breach of contract in the eula it says you much use a xbox, but this has never been tested to my knolege

It goes with the whole if you buy a CD and rip it so you can put it on your PC gray area. You own it technically but ehhh. People have done this with Wii games for the dolphin emulator

Not illegal remotely you own the disc and thus can do whatever so long as you don't distribute the data or something to that affect it doesn't matter from a legal standpoint

Not necessarily. I know American law has laws against "breaking digital locks." So by circumventing DRM, you could be breaking the law. That said, it's also one of those tree-falling-in-the-woods scenarios. It may be technically illegal, but if you're only using it for your own use, then there's no reason why any authorities would get involved. The law in this area is, as has been said above, a bit of a grey area. To a large extent, you need a test case to go before the courts to really make the statute law clearer in its practical application. The only case I know of off the top of my head is the iphone jailbreaking case, where apple tried to sue people jailbreaking their iphones, but the last I heard of that case the judge had ruled that it's ok to jailbreak a phone, which could be seen as breaking a digital lock. I'm not aware of any cases involving a person doing what OP said, but if there aren't any cases, it could go either way.

What I failed to make clear is this is a civil matter, not a criminal one. And people tend to think "illegal activity" as hitting criminal law. And really most of these laws anyway are just there so you have a reason to charge someone with a crime.

i suppose if he dumps his own bios for the emulator, personally playing a legally owned game in an emulator with a legally dumped bios should not be illegal, he could even use an iso personally dumped from the original owned disc (still in is possession).. it could be the console drive is broken and he can't get it replaced, and therefore uses an emulator to be able to play his game. (console must also be in his possession) but as said above, it depends on the law where you are, and to be fair, i don't think many gamers dump their own bios, so if he uses a bios found on the net, then yes, it's absolutely illegal

i can think of several reasons, broken console replacement, can bring games on trips on a laptop etc.. '

 

or maybe OP wants to stream xbox games, and wants to use screen capturing since it's cheaper than bying an elgato or something similar..

there are also those who use emulators to make "impossible for humans" speedruns (TAS)
 

also, for older consoles you can often improve how the graphics look through filters and different renderers with an emulator..

as you can see in the below video, running a game in an emulator makes the graphics more crisp

 

 

there are many reasons people want to run games in emulators.. and people should be allowed to do that if they own the hardware and software, as well as a personally dumped copy of the bios.

 

dumping an original xbox bios is actually fairly simple, as long as you can run modified software on the console, which again goes in to another legal debate, as modchips have different regulations depending on where you are.. where i am, modchips are fully legal to own, sell and install in your own hardware, but i know some places have them banned outright. (though in my opinion, modchips should be legal, as they are useful for other things than piracy, like homebrew or repurposing )

putting an xbox one disk in a PC will not do anything as the PC doesn't know what to do with it.

 

It isn't illegal to take a PS2 disk and play PS2 games with PCSX2. Just like it isn't illegal to put a sony CD in a phillips CD player and listen to the song.  Emulators do not infringe on any patents as they are made without any OEM trademark software.

It's been awhile since I've done any PC emulation but I remember having to seek out a PlayStation BIOS for the emulator I was using. That was definitely illegal. 

 

But it's like the kind of illegal that who cares? As long as you aren't doing any actual game piracy and the console isn't for sale or you own one already, you aren't hurting anyone financially.

Emulators do not come with bios because providing that would be illegal. They have no Sony code in them. The current ps3 emulator requires you to download the firmware from Sony's website, which Sony freely allows you to do

I meant the act of downloading the BIOS without the copyright holder's consent. An emulator that requires freely provided firmware is a little different than what I'm talking about. Like you can't just go to Sony's website to download a PS1 BIOS. Like I said, last time I did any kind of PC emulation, I had to download a PlayStation BIOS which I'm pretty sure is illegal as it was in no way provided with the copyright holder's consent.

 

But yeah, many emulators that require a BIOS won't come with one like you said because the developer doesn't want that liability. So that just falls to the end user lol.
