Montana becomes first state to implement net neutrality rules post-FCC repeal

As we all know by now, the FCC, led by known industry shill Ajit Pai, voted to repeal net neutrality rules federally last month. In a move going against this decision, Montana governor Steve Bullock has signed an executive order reinstating net neutrality rules within the State of Montana, while also requiring ISPs to be compliant with net neutrality rules if they wish to continue doing business within the state.

Montana Gov. Steve Bullock (D) signed an executive order on Monday requiring internet service providers with state contracts to abide by net neutrality principles.

The order makes his state the first to push back on the Federal Communications Commission’s decision to repeal the open internet rules last month.

“There has been a lot of talk around the country about how to respond to the recent decision by the Federal Communications Commission to repeal net neutrality rules, which keep the internet free and open. It’s time to actually do something about it,” Bullock said in a statement.

 

To justify this move, governor Bullock stated that this is a "simple step states can take" and that we can't wait for DC to "come to their senses and reinstate these rules." So, onto what the order says.

The order says that in order to receive a contract with the state government, internet service providers must not engage in blocking or throttling web content or create internet fast lanes. Those practices were all banned under the Obama-era 2015 net neutrality order.

The Republican FCC voted to dismantle those rules in December.

Basically, in order for an ISP to do business in Montana, it must not block or throttle web content or create paid "fast lanes", in attempt to manipulate what an end user can see online. Ah, but wait, there's the ban on states implementing their own rules, which Democrat state legislatures are challenging.

Further, Democrats are pushing for legislation in Congress that will overturn the FCC vote, as well as pushing for laws on the state level. This stems from the argument that net neutrality is an essential part of keeping ISPs, like Verizon and Comcast, under check; most Republicans disagree with this argument.

Democrats are fighting back by pushing for legislation in Congress that would wipe out the FCC vote, suing to overturn it and now by implementing laws at the state level. They argue the rules were an important check on the power of companies that control access to the internet, such as Comcast and Verizon.

But most Republicans, including FCC Chairman Ajit Pai, argue the rules were unnecessary and that existing laws are sufficient to preserve an open internet.

 

Governor Bullock says that while the rules will go into effect immediately, there will be a grace period for ISPs to ensure they're compliant. He is also inviting the 49 other state governors to do the same, going as far as promising to personally send a copy of his order to any governor who wants a copy.

The governor said on Monday that he is encouraging his counterparts and legislators in other states to follow suit, promising to personally email a copy of his order to any who ask for it.

 

The governor concluded with the following:

“When the FCC repealed its net neutrality rules, it said consumers should choose,” Bullock said in his statement. “The State of Montana is one of the biggest consumers of internet services in our state. Today we’re making our choice clear: we want net neutrality.”

 

Thoughts? Concerns? Screams of agony? Personally, I'd be glad to see Comcast lose their contract with Montana. Hit 'em right where it hurts, right? Maybe then they'd feel a bit more like actually being a good, reliable, trustworthy ISP. I'd also like to see Massachusetts governor Charlie Baker be first governor to follow in Bullock's steps. It only makes sense for us to do so.

This is going to be like legalizing weed but much worse. I don't think Ajit will be too happy and the federal government will put a stop to it but I like it

The GROCERY STORE I shop at was hiring NIGHTTIME STOCKING STAFF an the flyers on the walls only had an web address and QR code for actually making an application.  So yeah, increasingly so, the most basic forms of employment can't be applied for without internet access.  So so many, and more and more every day, the internet is utterly critical the most basic needs of a functional life.

More and more stores are shifting job applications to the internet down here in the States as well. It basically is an essential part of the modern life.

I do get why the FCC made the point of telling states not to implement their own rules, so as to avoid a bunch of different regulations depending on which state was being operated in.  Having said that, I'm all for states deciding this matter individually.  If Montana wants to make a go of it, be my guest.
