Psychic Network sues Rockstar over GTA: Vice City

This has to be one of the more humorous articles that I've read today...  The Psychic Network has decided that the Auntie Poulet character from GTA: Vice City (released in 2002) is a copyright infringement on the Miss Cleo persona that they created and therefore Rockstar owes them money.

Grand Theft Auto: Vice City was first released so many years ago (2002) that you’d be forgiven for not remembering the character of Auntie Poulet. But the Psychic Readers Network certainly remembers her. It says the fortune teller violates its copyright on once-famous TV psychic Miss Cleo, and has launched a lawsuit against Rockstar and Take-Two Interactive for the alleged infringement.


The suit says Psychic Readers Network spent $100 million creating and promoting Miss Cleo over the years. It claims Rockstar made over $500 million “exploiting” the persona, and notes that the actress who played Miss Cleo on TV also provided the voice for Vice City’s Auntie Poulet.

Psychic Readers Network says the reason its waited 15 years before deciding to launch a lawsuit is because Rockstar keeps making money from Vice City though reissues – the game was re-released for smartphones and tablets in 2012 to coincide with its tenth anniversary. Surprisingly, most people have reacted to this claim with a heavy dose of skepticism.

Responding to the claims, Rockstar said they "are entirely meritless and completely ridiculous. We will vigorously defend ourselves with regard to this matter."


The situation brings to mind the Lindsay Lohan and Karen Gravano (Mob Wives) lawsuits launched against Rockstar over their supposed likenesses appearing in GTA V. Expect this case to be thrown out just as quickly as those suits. It's just surprising that the Network hasn’t used its psychic powers to foresee all this.

So this is a very frivolous lawsuit, but who knows, maybe the Psychic Network received some message or information that they would win this...  I however, would not place bets on this as I'm fairly sure there is a statute of limitations on copyright suits that has long since expired.

Just more proof that copyright law is dumb and needs to be changed.

For those who aren't aware of how much copyright law has been extended, here is a quick summary:

 

Copyright used to only be valid for 14 years. That meant that if you created for example a character 2000 under the original rules, the year 2014 that character would become public domain and anyone could use the character however they wanted.

 

Then they decided that wasn't long enough and made it 14 years, and if the creator was still alive it could be renewed for an additional 14 years. That meant that for certain types of works (I believe it was only for books and maps), the copyright could be valid for up to 28 years.

 

After a while they decided that wasn't long enough and extended it to 28 years, plus a 14 year renewal. All of a sudden copyright could be valid for as long as 42 years.

 

But since that still wasn't long enough, they decided to increase the length of the renewal to also be 28 years. So now we had 28 years as standard, with a 28 year extension. Now we're up to 56 years. 56 years sounds like a quite long time to have monopoly on a work/character, right? Surely that must be enough for the creator to reap all the rewards of creating something.

Nope, apparently not because...

 

When Disney was about to lose the copyright on Mickey Mouse they started lobbying to have the period extended. Their efforts were successful and as a result the new copyright law was that as long as the creator was still alive, their works would be copyright protected, plus the copyright would be in effect for 50 years after their death (50 years were chosen because that was the norm in Europe).

This ruling also made a retroactive extension to all works published by a company before the new ruling. That retroactive extension increase the copyright protection from the previous 56 years max, to 75 years.

This resulted in everything published before 1922 becoming public domain, but everything after could still be under copyright (such as Mickey Mouse which first appeared in 1928).

 

But as 2003 approached (the date Mickey Mouse would become public domain), Congress decided to change the rules once again. They increased the previous "50 years after the death of the author" extension to now be 70 years and company creations would be 95 years from the day of first publication (or 120 years from the year of creation, whichever comes first).

That meant that Mickey would be protected until 2023.

 

I would be very surprised if we don't see the terms get extended again as we approach 2023.

 

Personally, I would like to go back to the old 56 year copyright system, or at the very least the "author's life, plus 50 years" system.

Not that it would change anything about this lawsuit but since there might be changes to copyright law soon (to protect Mickey) I think it is important for people to know what an idiotic thing it has become. What started out as being a 14 year period is now easily over 100 years in most cases.

Let's all hope that some company like Google (who is under constant bombardment from copyright claims) will stand up for the people the next time copyright law is going to be extended.

That's true of trademarks, not true of copyright.

 

If I make an octopus character, and Johnny copies it without a license but I don't go after him, I can still go after you if you copy it without a license.

 

And as an extension, if I for example, name that octopus Snipey and trademark the name "Snipey's Guns" to use for my store, I have to defend that trademark for "Snipey's Guns" or risk losing it. I do not however have to defend the Snipey octopus character since that character is my IP, and I am free to allow others to use it as I wish.
