Internet is NOT a communication channel

In the recent 9th Circuit Court ruling on FilmOn X's fight for providing TV over the Internet posted on Ars Technica (https://arstechnica.com/tech-policy/2017/03/hope-fades-for-cheap-tv-over-internet-as-filmon-loses-copyright-fight/), the 9th Circuit Court authored in their opinion that:

It is far from clear whether the Internet counts as one of the " other communication channels" envisioned by 17 USC 111.

Basically this fight is over the definition of a Cable System in Section 111 of the Copyrights Act and whether the Internet can be qualified as a 'cable system'.  I'm no legal scholar, but this seems like a ludicrous argument considering there are still a good many people that receive cable and internet service through a single coaxial cable, on the same infrastructure.  One other hilarious quote from this article is:

Is it too much to hope that either lawmakers or judges dealing with technology law receive a bit more education on the technology that the law is covering?

Wow, so much bullshit in one article.

 

That definition doesn't make sense - nowhere is it stated that a communication channel has to have the same bandwidth and noise throughout the system (which by the way isn't even really true for normal television as noise levels are definitely variable). If that's not what he meant, what DID he mean? Because arguing that the physical infrastructure of the internet is not characterized by bandwidth, noise and throughput is nonsense.

Doing a bit of reading on Wikipedia (https://en.wikipedia.org/wiki/American_Broadcasting_Cos._v._Aereo,_Inc.) the topic and one of the preceding cases (American Broadcasting Cos. vs Aereo Inc.) I find it interesting that while the majority of the US Supreme Court ruled on behalf of the Network Broadcasters, the dissenting judges stated that the Court.

No. Quite the contrary. It's the ones who have more say-so that tend to come across like they don't know things, when they actually do know what the internet is and how it works. But because of how they are used to doing things, what their political values are, and if they're being persuaded under the table, is when stuff like this happens. What makes this worse is reasonable people who don't have peers who are tech savvy tell them otherwise will attune to the same beliefs that these lawmakers will talk about.

 

The same thing happens when you go onto some random forum and talk about how much better Nvidia is than AMD right now and that AMD needs to step it up. You can be guaranteed that a brigade of super outspoken individuals will come out of the woodwork to tell you how wrong you are since AMD is cheaper on performance per dollar, start linking random articles that you know for a fact are complete bollocks, and so on. To typical passerbys who don't know any better, their arguments may seem more convincing.

I'm assuming this is meant in the context of transmission of analog signals. Hence bandwidth is meant to be the frequency range of the signal, noise is how much signal power is lost from interference, and throughput is of course actual data rate.

 

In this context, pretty much the only part of the Internet that is included would be over coaxial cables. Regardless, the Internet is still a channel of communications.

Realizing my budget is a lot less, I work my way to "I think these new games will run on a cheap ass CPU."

Then end with "The new parts launching next year is probably gonna be better and faster for the same price so I'll just buy next year."
