No, because the idea of a patent is that it has to be a new thing. If your patent has "prior art" then it should be invalidated.

For example if you invented let's say a new type of shoelaces which are easier to tie. You start selling your product and then after a while I come along. Since you don't have a patent I decide to submit my own patent for the thing you are already selling. What happens next? My patent request should get thrown out because you can not patent something that already exist. The consequence of you not patenting your product is that nobody can patent it.

That's why nobody has a patent on for example the wheel. Prior art invalidates any attempt at patenting it today.

 

The system is extremely broken though so patents with lots of prior art gets accepted all the time.

this is actually not really unusual, any big corp tries to patent everything when they think it is possible.

not for me, I came across plastic bottles branded with a small "patent pend." text and number on them at some tech/electronic shows, it's really weird how far some companies can go.

I don't see how this is a story. Apple design their own bags for their retail stores, rather than outsourcing. Then they patent the design, as is standard practice.

 

This is such a non-story.

They haven't patented a bag, what they have is a methods to have a high recycled bag that is white and strong. High recycled materials and bleaching weaken it by a substantial amount.

no they patented the bag not the process of making the bag. the figure in the patent is of the bag and they named it "bag"

yeah because of the folds it has in order to make it strong enough. basically is a bag folded to make it stronger.
