Police chiefs want means to get passwords (Canada)

The police chiefs' resolution comes as the federal government begins a consultation on cybersecurity that will look at issues including the best way to balance online freedoms with the needs of police. The consultation runs until Oct. 15.

Police demands for access to online communications and the concerns of civil libertarians about privacy rights have created tensions around the globe in recent years.

The issue came to fore last year when the U.S. Federal Bureau of Investigation went to court in a bid to crack the password of a terror suspect's iPhone following a mass shooting in San Bernardino, Calif.

Investigators cannot read and interpret data and other potential evidence due to the technological barrier encryption poses, even after data is lawfully seized, Oliver said.

tbh, no one should have to hand over any password, ever. regardless of what they did.

the second you have one password from someone, many things can happen.

  1. it can be leaked
  2. you can figure out other passwords (most people use variations)
  3. your personal life may be / is at risk

 

what if the person has not done anything ?
could you just be brought to court by error and suddently have your whole life given away ? no privacy ?

this should not happen in my opinion. ever.

Those are a few natural rights in Canada which I see as preventing the police officer's idea from becoming a reality.

 

Police are typically extremely low-brow people, who don't have a lot of perspective for what considerations are at work in the mind of society. They just see the bad guys, and what would help to get the bad guys easy. They see getting bad guys as more important than having and protecting rights, and their mind-frame doesn't work without having a bad guy to get.

 

So, police ideas are often not well-considered, beyond 'this'll make getting the bad guys easier.' And I don't expect this proposal to be accepted by Canada's courts and lawmakers.

I always have one question about being forced to give up a password.  What if you "don't remember it"?  Are you punished for forgetting?  While it could be hard to claim you don't remember your phone PIN, you could easily say you don't remember other passwords.  What if you give a "fake" PIN?  What if you give a self-destruct PIN and it wipes the device?  How do they prove you gave a self-destruct PIN intentionally?  What if you were scared and got confused?

Legislating encryption on general purpose (user has control) computers is technologically unfeasible.

Ahh, as always the government thinks privacy = criminal behavior.

 

If I were Canadian, I'd not only stand up against this law before it gets passed, I would absolutely refuse to comply. Deal with the jail time, the more of you that absolutely refuse to comply, the worse off they look.

 

Remember, a law is not a law if the public refuse to abide by it. The politicians only choice then is to repeal. It's called civil disobedience, and it works.

Not sure how I feel about this... On one hand, I'm all for criminals/terror suspect not having any sort of privacy when it comes to investigation, but on the other hand, I can see how this can/will be abused and it terrifies me.

No, they just force you to unlock with your finger or eye.  Currently the US court has determined that bio-metrics are not protected.  Since you get fingerprinted when you get arrested anyways, your fingerprints are considered freely available, they don't even need a warrant to use them (they may to access the phone, but not to get your prints).  I believe there was a similar case/ruling about retinal scans.  Bio-metrics are considered unprotected, and should never be used to secure your anything, not as a single factor at least.

Here in the Netherlands we had the justice minister proposing the exact same thing, luckily it didnt go through the system. It didnt get passed due to the illegitimacy of the proposal in the way that you can not be forced to produce evidence against yourself.  

 

Why I think its wrong:

 

You have the right to stay silent, but can be forced to tell them your password? What kind of shit is that?

 

Personally I would set up a second password that would erase the home directory, and fill empty space with 0's. Good luck recovering that data from my ssd xD

But is this not already the case at borders? I know it's a show but on border security, when people get pulled into secondary, they ask for their bloody phones unlocked so they can go through them. In my eyes, this is ridiculous, I'm not a criminal, I do not want to allow some border officer full access to completely snoop my phone.
