Prosecution argues that turning on your phone means you consent to being tracked

Baltimore Police obtained an arrest warrant for Kerron Andrews, in 2014, for attempted murder. In an attempt to find him, they used his cell phone.  They used a Hailstorm (a type of Stingray) to track the cell phone. Not only did they fail to disclose this, they never got a warrant to actually use the device. A Hailstorm is essentially an IMSI-catcher where it acts like a mobile tower and MITM attacks are conducted on cell phones that connect to it. A big problem is that it’s indiscriminate and ends up scooping up innocent bystanders’ information., Baltimore Sun reports that they “have used the technology 4,300 times since 2007.” 

In August 2015, another judge concluded that the police had violated Andrews’ Fourth Amendment right because they used Hailstorm without a warrant, and thus granted the defense’s request to suppress all evidence the police obtained as a result of using Hailstorm.

“While cell phones are ubiquitous, they all come with an “off” switches. If a cell phone is turned on, it is receiving signals from cell towers, and sending signals back out to cell towers. The cell site simulator used in this case took advantage of that fact in order to locate Andrews’ phone. Because Andrews chose to keep his cell phone on, he was voluntarily sharing the location of his cell phone with third parties.”

 

The state has appealed the decision, and in its filing it presents a legal theory that is disturbing. The prosecution says that since every cellphone sports an off switch, Andrews' decision to have his phone turned on indicated he was consenting to be tracked. 

If the appeals court goes along with this argument and allows the evidence collected by the Hailstorm to be used during the trial, it will mean that as far as the cops are concerned, you are giving up your privacy each time you press that power button on your handset and turn it on. If the Maryland court overturns the ruling and says that the suppressed evidence collected by the Stingray device is admissible, look for other state courts to begin citing this ruling when justifying the use of bulk collection tools without a warrant.

I'm torn between the ability to catch wanted criminals and the right to privacy.  I disagree that you surrender your right to privacy just by having your phone turned on.  Maybe an arrest warrant should cover methods of locating individuals so this becomes a non issue before it even starts.

That's exactly how I felt in Life is Strange about the whole camera thing. However that was due to exterminating circumstances, in real life though I'm pretty much always of the opinion that privacy should never be sacrificed for security. Since I think that security without privacy is basically meaningless.

Nowhere in a phone contract is this implied.  So, he never consented to a search.  In order to use any method of getting into a device/property of an individual, the department needs either a warrant or probable cause.  The only thing they have going for them is a possible grey are in probable cause.  Now, the only way they could get probable cause is if they could prove he was doing something illegal at the time.  If they knew it, and he was running then he does forfeit certain things.

A warrant is still needed though even if the police have some evidence....that's kind of the problem here. They've been using mobile phones to track people without a warrant.

Thing is though, once you lock onto a phone, you can siphon all data going back and forth, meaning this tracking can instantly turn into direct targeted surveilance. Upon which you DO need a warrant.

Then again, why is anyone shocked?? I mean this is the exact same technology NSA used a couple of years ago to spy on the German Cancellor and some other european politicians. We saw how that went down. You know, it takes a sp

That's like saying having doors on your house means you consent to a warrant-less search: just utter fucking bullshit of a careless prosecutor trying to win a case for personal career and not caring about the dangerous precedent being set.

"not care"?  You are under the impression that the future you fear isn't the exact future the prosecutor is trying to make.  You forget, the prosecutor is on the same side as the police.  They want total and unrestricted power to be able to view and track and monitor and detain you for any reason or even better, no reason at all.  In the eyes of the police, you are guilty because you aren't one of the police.  In their world view, there are cops and criminals.  You are guilty, they just haven't figured out why yet.

 

The best example I can provide:  "Pick up that can".

By that logic, since everyone has the option to not leave their house, they consent to being followed if they do.

Although the ridiculousness of the argument is somewhat undermined by the fact that they did have an arrest warrant for attempted murder on the guy.

Or the whole, if you leave your doors unlocked it's perfectly fine for someone to open that door and steal whatever is inside. Or my favorite that I see all the time, women are just asking to be raped when they wear revealing outfits.

So basically, they did something without a warrant (which is illegal, and puts a giant hole in their case, which is unfortunate if the suspect is indeed guilty), and came up with a bullshit argument, that will make their activities blanket legal in the future.

Ketchup is better than mustard.

They can still track your phone when it is off. If you turn your ipone off off like holding the power button find my iphone still works and when the battery is going to run out it sends a message to you and apple of the location
