I don't know, I really now nothing about US law, but I reckon if they can prove bit coin has a value (which won't even be hard as it has an exchange rate),  then it will not be hard to prove he has amounted wealth (remember wealth is not currency/commodity specific) through an undetermined processes.  In this specific case I think bitcoin can be likened to a brand new car, it is neither a commodity nor a currency but is an asset that has a definable value.

 

Then it will be up to his lawyers to prove he did not amount all that wealth through illegal activity on the silk road.
