To my understanding, unpaid fan art is classified as a shared copyright between the artist and the copyright holder of the represented persona or figure in the art. So in this case, if you make a drawing of Linus (as he is a public figure), a right to that art is granted to both you as the artist and Linus as the figure being portrayed. Neither license holder can profit from that work without the express consent and approval of the other ie. we can't slap it on a t-shirt and sell it on our merch store without your consent as the artist, and you can't sell a print or shirt of it without Linus' (in this case LMG's) consent as the figure portrayed in the art.

 

So you can make whatever fan art you want, as long as you don't use direct logos or other copyrighted marks, and as long as you don't sell or attempt to license the art without our explicit permission.

 

Can I request donations if I also link the LMG merchandise store?

No; not without our express written consent, which in this case we would not grant.

 

 

On to the meat of the topic...

 

While we appreciate your interest in the community at large and our team, we respectfully request that you do not create this sim. We would not provide permission to use the name or likeness of any individual on our team in this manner, and we would not provide permission to use the names or logomarks of our company(ies) in this manner. The likeness & persona of each individual team member would be misused and misrepresented in this type of endeavor, and that is not something that we are comfortable with.

 

TL;DR We are not comfortable with our company - or the individuals within it - being used in this manner. Please do not do this.

I think this is the best place to put it.

I tried sending an inquiry a few weeks ago via LMG's non-forum site.

 

What are the restrictions for fan art? IE What can I not make?
Can I request donations if I also link the LMG merchandise store?
 

I ask because I want to make a LMG dating sim; the LTT fan fiction from my signature was well received-I see that as a possibility to make some more content for those interested. I know @floofer was hoping to see more.

 

I didn't see any section on restrictions nor partnership like requests anywhere & as I've said, I sent an inquiry via the form on the other website.
If LMG would like to screen the events occurring in the game before release, they can choose to censor whatever they wish if that's a condition. I would obviously do my best to keep it as suggestive as LTT videos where nothing actually takes place.
If LMG is completely opposed to having their name on the product, I can do what I can to distance it from the company as much as I can. (IE, no company name, no employee name, plus additional specifics stated to me within reason) Additionally, no computer manufacturers nor owned technology names would be mentioned in the game-unlike my fan fiction which had mentioned SLI.

 

Thank you for your help. I would prove all license ownership upon request for every technology I use in private messages or email. I feel like that's everything you'd want to know.

I spent $2500 on building my PC and all i do with it is play no games atm & watch anime at 1080p(finally) watch YT and write essays...  nothing, it just sits there collecting dust...

Based on past results, you aren't allowed to ask for any donations while using anything directly related to LMG. Besides logos thats would include personel. Besides that, while they are somewhat public figures, you should really ask their permission to be used in your stuff. Otherwise its violation of privacy.

"space balls is to star wars as this sim is to LMG"
Would that be acceptable? (removing the idea of asking for any donations) If not, I will not proceed any further with development & will discard all existing writing.

I mean... Spaceballs exists because it didn't need Star Wars' approval to exist. So I don't really feel that it's our place to provide much comment on that.

 

I'll just say that we'd strongly prefer to not be involved in this sort of endeavor in any way haha.

Your accuracy needs some Wikipedia. Even parodies, if made money with or overall, need approval or original creator. Which is, as you should know, why copyright laws with covers are so tricky.

? Feel free to point out where you find my assessment to be incorrect. I've done some digging on the topic, and it is a fairly nuanced issue with a lot of "case-by-case" aspects but I'm pretty comfortable with my general understanding.

Heh, the more you know. I guess Spaceballs is a bad example as it's meant to be more of a full parody than a referential piece - not exactly a perfect comparison in this case.
