Privacy search-engine company DuckDuckGo submits “The Do-Not-Track Act of 2019” to improve online privacy

The creators of privacy-based search-engine DuckDuckGo have written proposed legislation for the US that would enforce greater privacy of online user data when people enable Do Not Track features in their browser. As DuckDuckGo write, currently many websites ignore when people enable the Do Not Track setting in their browser.

 

Overview of the Do-Not-Track Act of 2019

When you turn on the setting in your browser that says “Do Not Track”, you probably expect to no longer be tracked on most websites you visit. Right? Well, you would be wrong. But don’t worry, you’re not alone.

 

Our recent study on the Do Not Track (DNT) browser setting indicated that about a quarter of people have turned on this setting, and most were unaware big sites do not respect it. That means approximately 75 million Americans, 115 million citizens of the European Union, and many more people worldwide are, right now, broadcasting a DNT signal.

 

All of these people are actively asking the sites they visit to not track them. Unfortunately, no law requires websites to respect your Do Not Track signals, and the vast majority of sites, including most all of the big tech companies, sadly choose to simply ignore them.

 

Let’s change that now. Let’s put teeth behind this widely used browser setting by making a law that would align with current consumer expectations and empower people to more easily regain control of their online privacy.

 

While DuckDuckGo actively supports the passing of strong, comprehensive privacy laws, we also recognize that it will take time for them to take effect worldwide. In the meantime, governments can provide immediate relief by enacting separate, simpler Do Not Track legislation.

 

It is extremely rare to have such an exciting legislative opportunity like this, where the hardest work — coordinated mainstream technical implementation and widespread consumer adoption — is already done.

 

That’s why we're announcing draft legislation that can serve as a starting point for legislators in America and beyond. It’s entitled the "Do-Not-Track Act of 2019" and, if it were to be enacted, would require sites to respect the Do Not Track browser setting in this manner:

 

1. No third-party tracking by default. Data brokers would no longer be legally able to use hidden trackers to slurp up your personal information from the sites you visit. And the companies that deploy the most trackers across the web — led by Google, Facebook, and Twitter — would no longer be able to collect and use your browsing history without your permission.

 

2. No first-party tracking outside what the user expects. For example, if you use Whatsapp, its parent company (Facebook) wouldn't be able to use your data from Whatsapp in unrelated situations (like for advertising on Instagram, also owned by Facebook). As another example, if you go to a weather site, it could give you the local forecast, but not share or sell your location history.

This proposed act is a small part of what's needed, but it's certainly a good part. When people have told their browser they don't want to be tracked, that setting should be honoured, and I think that companies ignoring that setting should be punished.

On topic: It's about time that legislation be made to curb the use of our data. The internet was meant to be a free resource and companies are trying to profit off of our data and behavior. Tracking should be set explicitly across the board.

These Do Not Track requests can be mandated client side through the browser, legislation is not required to do what the bill wants. The problem is that there is really only one browser which takes a strong stance on this stuff, Safari. 

 

Don't get me wrong, privacy laws and all that are great, but I also realize that if these companies really cared, they would already be taking measures to implement their ideological goals on their own. Currently the only major brand that I see doing that is Apple. 

 

(Not to say DuckDuckGO isn't trying, they are just a search engine after all, they don't really have control over what websites do and they don't make their own browser)

I am talking about privacy from the government not advertisers. Apple is a closed ecosystem so you have no way to prove they aren't doing anything to help the government. They are the most valuable tech company in the world I highly doubt the government has done nothing and just sat around watching them.

Probably because it would stop them fucking customers over when the sub-par devices they sell break. Apple can't recover data from a device, but the FBI can using a backdoor that Apple implemented. Maybe the FBI won't take "Is there a chance it has been water damaged?" as an excuse, and challenging them in court to get the lawsuit dropped was easier than publically admitting to bullshitting customers and selling "unrepairable" devices on to the next customer that's screwed over for a few hundred.

What else would they do with a failed logic board that costs a few cents to repair? Sell the customer a refurbished one, replace the capacitor on the "beyond" repair unit then put that in the line to be sold on to the next customer with an "irrepairable" board. Speeds up the turnaround for repairs, saves them building new boards at the end of the products production life (new model every year or so) and makes them hundreds for what is quite often a design related failure.

 

It happens all the time in TV repairs. Sell the customer a new power supply, replace the failed capacitors on the old one and keep that on a shelf ready to sell to the next customer with a failed power supply. I could have made so much money repairing and selling "scrap" TV's, my 50 inch plasma needeed a single solder joint reflowing, I got it free. Could have sold it for a few hundred as "refurbished".

Yes I acknowledged that. Apple doesn't need to go to the government to keep being a privacy advocate, they are a business with near unlimited resources. They are doing more than the government can right now, as a company instead of sitting and hoping that some law passes.

These Do Not Track requests can be mandated client side through the browser, legislation is not required to do what the bill wants. The problem is that there is really only one browser which takes a strong stance on this stuff, Safari. 

 

Don't get me wrong, privacy laws and all that are great, but I also realize that if these companies really cared, they would already be taking measures to implement their ideological goals on their own. Currently the only major brand that I see doing that is Apple. 

 

(Not to say DuckDuckGO isn't trying, they are just a search engine after all, they don't really have control over what websites do and they don't make their own browser)

Actually, DuckDuckGo has their own browsers for different platforms...

They have tracker blocking as well as webpage rating depending on their privacy policies. DuckDuckGo is of course the default search.

Ok. Now I see that they have already done what they can privately, like Apple. Meaning they've already put their money where their mouth is. The difference is DuckDuckGo is now just being a privacy policy advocate. I've got no problem with that.

I'm not entirely sure if the do not track stuff is an API or not. If it is, that means devs just need to implement it. If it's not an API, that means Apple just wants people to use Safari and not use other browsers. I don't blame them though, I wouldn't use another browser other than safari if I had the choice.
