  2. Unless they can prove that fortnite directly used assets from pubg i don't think this should be a valid case just because the two games have some similar mechanics. A company shouldn't have the exclusive rights to gameplay design eg dota shouldn't be able to sue league of legends just on the fact they are both moba games.   3. https://www.theregister.co.uk/2018/01/17/amd_investors_sue_over_chip_flaw_silence/ A lawsuit was filed in California against AMD, claiming they artificially inflated stock prices by not announcing the Spectre vulnerability. I'm not sure the suit will stand, given that the product was already launched well before the vulnerability was discovered. It's not like they rushed it to market after learning about Spectre, that was all discovered well after the product was released to market. Especially given that the lawsuit alleges the artificial inflation goes back to FY 2016. Another nail in the coffin of this lawsuit, is that the stock prices have actually gone up since the announcement about Spectre. *EDIT* I apparently overlooked this, there was a link to the original filing in the above story. https://regmedia.co.uk/2018/01/17/amd_cpu_design_lawsuit.pdf *EDIT2* I just noticed one more bit of information (and this is why I shouldn't post late at night, when I should be sleeping). Apparently, the guy bringing the lawsuit bought his shares on the 8th. Of January. Of this year. In other words, he apparently bought shares after the Meltdown bug was announced, while AMD was saying there was little chance of vulnerability from Spectre. After AMD announced they were vulnerable to Spectre, the shares dropped by 0.99% (or $0.12), meaning he lost money on a gamble (around $1,200) and now wants to cry foul.

Tavis Ormandy, member of Google's Project Zero just tweeted about a Lawsuit filed by Keeper Security (Keepass) against Ars Technica on "Misleading Claims" for their "Windows Bundled App" Article. On the original article by Ars Technica, they describe how Tavis Ormandy (re)discovered a flaw on Keepass after noticing that windows 10 was bundling the app after installation. According to Tavis, the flaw was exactly the same as one he had perviously disclosed (Issue 917), which had been patched by Keepass (back on August 2016). The article also indicates that this issue could have been avoided if Windows wasn't downloading the app without the user's consent, as it should only affect users that accepted to use the app by trusting it with their passwords. Today, however, Tavis Ormandy tweeted about the lawsuit which has been filed by Keeper Security (Owner of Keepass) against Ars Technica, this was followed by a link to the public case and later by the case's document. Crytek has filed a lawsuit against Cloud Imperium Games over breach of contract during the development of Star Citizen and SQ42 The source will be the legal paperwork which is located: HERE and an article which was launched by massivelyop.com Some of the main points from the lawsuit: Crytek Inc is suing on 1 count of Breach of Contract and 1 count of Copyright Infringement and Crytek demand that they're awarded $75'000 in damages, including loss of profits, they also request that the defendants (Cloud Imperium Games) are issued a permanent injunction from the continuation of the work which will inadvertently destroy the development of Star Citizen and SQ42. You may want to be cautious about using any images from Getty in any circumstance, there have been multiple reports of people getting letters from Getty stating that they have infringed their copyright and demand a $120 or so fee. One woman by the name of Carol Highsmith received one such letter recently, the catch was the infringing photo was her own that she donated to the public domain via the Library of Congress. She soon discovers that Getty and other stock image sites have taken her entire archive of public domain photos and licensed them without her knowledge or permission, she is now suing for $1 Billion. If you don't know what any of the sites are CSGODiamonds is a dice role site where skins are gambled, and CSGO Lounge is a site where you bet skins on teams. OP skins is a market site where you can buy the items for much cheaper then they are on the steam market, and don't have the 7 day trade ban. My only question is why OP skins? It's a market place, like the rest. I don't understand why they don't sue the other sites like it as well. That makes me think the guy is just going after the money, since OPskins is by far the largest site of the type. Don't think this case will go far. Want it to, but probably won't. Worst part about these sites is they sponsor streamers who have younger audiences (Wild/ Lotto + Crew). Pretty much knowing about it. That's just scummy imo. TL;DR I'm glad Valve's being sued, they're profiting way to much by this just sitting back knowing under age kids are betting, kinda sad lounge is because I've made (and lost) lots of money on there.   13. On the issue of "The Fappening," I question Linus' assumption that the "hack" took place solely via social engineering. Either more than 100 individuals (many celebrity-status) were dumb enough to be duped by someone using an email username "appleprivacysecurity" (a court document description), or, there was an exploit present in the "Find My iPhone" service that allowed unlimited attempts at brute-forcing a password...and if "hackers" got a hold of legitimate Apple iCloud usernames, they used a pre-compiled tool that guessed the associated weak passwords (or weak security answers.) The wiki is ambiguous about the exact route but Occam's Razor is telling me there was a flaw and "appleprivacysecurity" wasn't able to successfully dupe so many celebrities into giving away their password to unknown sources. Some have speculated the information was collected months before over insecure MitM wifi hotspots at high-profile events, but that can be dismiss-able given proper authentication methods (and not some incredibly-retarded old Bluetooth implementations that Bluesnarfing and "Linkkeys cracking" exploit which may or may not have gained access to Paris Hilton's pics on her phone back in 2005.) Now, "guessing" people's security answers can be a different story -- this was how Sarah Palin's personal "Yahoo!" email account was "hacked" by some kid (David Kernell) of some state-level democrat and subsequently changed the password to "popcorn" and posted it on 4chan back in 2008. The court battle was a huge mess. 4chan creator Christopher Poole was called in to testify about the most basic internet terms like "OP" and "lurker." Prosecutors were clearly technologically-inept and accused the proxy operator that Kernell used ("Ctunnel" operated by Gabriel Ramuglia) of ridiculous plots of collusion for political gain in that election year -- which unsurprisingly never held up in court. Ramuglia was PISSED after that and subsequently stopped all of his logging which previously aided the case. As some of you may know, this is when "Yahoo!" changed their security questions to whatever you want versus a small list of drop-down questions that are relatively easy to guess the correct answer. Back to the fappening, I honestly suspect that after 4chan implemented a more "takedown-friendly" system of pics...because people kept spamming the same pics over and over again, Poole was fed up with the mess, didn't want to be involved with another court battle, so he quit. I seem to recall reading about similar stories of some of the employees over at Imgur -- twitter posts like "Welp, my entire work day consisted of nothing but taking down pics" during the frenzy of threatening lawsuits against a wealth of individuals and organizations. Apple eventually officially stated that it was "a very targeted attack on user names, passwords and security questions, a practice that has become all too common on the Internet." Now, that's some weasel wording if I've ever read such a statement. It doesn't claim negligence while appearing to offload most of the blame on "the evil internets." It's factually accurate for both situations: there was a flaw in the "Find My iPhone" service since "weak passwords" is a factor, OR Apple's security was in fact bullet-proof at the time and it was "appleprivacysecurity" accounts duping 100's of individuals. The resultant FBI investigation was unsurprisingly lackluster and provides very little information other than, "people are still being investigated," dated October 2014 -- the latest update thus far, 16 months ago. My theory: Apple screwed up in a way that most of us don't know about and it was determined henceforth to not let it happen again; they quietly re-designed their security implementation to the point where, if it wasn't bullet-proof before, it sure as hell will be 99.̅9% bullet-proof from now on. Hence the present "we're not budging" stance on re-writing our intellectual property (because we potentially got burned once and outright refuse to implement Pandora's Backdoor.) I despise the fact that so many people think this is nothing more than an uninformed conversation like, I expect this to get all the way to the Supreme Court and will ironically get a tie vote. Instead of giving the lower courts the winning decision in the case, wouldn't a simple coin flip that determines if future devices now turn into Telescreens from 1984 (watch the movie)...be more interesting?   17. Well Samsung and Apple are at it again, this latest fiasco is over the newly released Samsung Galaxy S6 and S6 Edge. Apple is stating that 3 of its patents have been violated and it is looking to stop the future sale of Samsung’s newest phones in the North American market. The first violation has to do with the antenna band placement location on the phones, Apple made the patent claim when they released the iPhone 4s, which the new Galaxy phones share the glass back design with. Also Apple is claiming that Samsung purposely copied their design language with the new phones, stating that the button layout and design look was stolen from the iPhone 6. This isn't the first time Samsung has been in legal troubles with Apple, though this is the most aggressive patent lawsuit Samsung has faced by Apple. Apple won the last series of suits against Samsung, this time it looks like that will happen again as Samsung honestly doesn't have much of a leg to stand on. Around this time last year Apple filed suit against Razer for the design language of their Blade 2014 laptop, the case was settled outside of court and details of the final settlement are fuzzy. Source: arstechnica.com & engadget.com On April 13 the FCC Published their Net Neutrality Rules that were passed Feburary 26th The official publication of these rules allows for parties who are against them to file for lawsuit against the FCC. Within the same day a trad group knowledge as USTelecom filed for a suit against the FCC saying that the FCC rules: "violates federal law, including, but not limited to, the Constitution, the Communications Act of 1934, as amended, and FCC regulations promulgated thereunder."   20. The company says the FCC overreached by passing rules to stop Internet service providers from blocking sites and slowing traffic. The problem is, Comcast’s admitted to doing just that. I guess its hard to sue the FCC over imposing rules that you've been violating the entire time already, among other dodgy practices over the previous decade. ATT and Verizon seem happy to sue, Comcast might still lobby like hell, but one of their VPs as of today has said they won't being suing the FCC over the latest rulings. This does go at odds against the Exec. VP Cohen who said that they will be suing, so who knows whats going on in Comcasts ranks and who actually supports the FCC ruling and who doesn't. The legal actions, announced Friday, relate to Ericsson-owned patents. The company has filed two complaints with the US International Trade Commission and filed seven lawsuits in the US District Court for the Eastern District of Texas against the iPad and iPhone maker, alleging that 41 patents in total are being infringed on. Ericsson has also asked the trade commission to block Apple products in the US market. The patents in question include technology related to 2G and 4G/LTE standards, semiconductor components, user interface software, location services and applications, as well as the iOS operating system itself. Ericsson claims that Apple's global licensing agreement for Ericsson's patents expired last month and that Apple "declined" to take a new license based on fair, reasonable, and non-discriminatory terms -- known in the industry as FRAND. The company says several attempts were made to reach a solution with Apple, including "an offer for both parties to be bound by a decision on fair licensing terms by a United States federal court." However, Apple allegedly refused. "By refusing Ericsson's fair and reasonable licensing offer for patented technology used in Apple smartphones and tablets, Apple harms the entire market and reduces the incentive to share innovation," Ericsson said. Ericsson's portfolio includes approximately 35,000 patents, and the company has inked roughly 100 deals with industry players to date. "Apple's products benefit from the technology invented and patented by Ericsson's engineers. Features that consumers now take for granted -- like being able to livestream television shows or access their favorite apps from their phone -- rely on the technology we have developed," Kasim Alfalahi, chief intellectual property officer at Ericsson said in a statement. In related news, this week Apple was ordered to pay $533 million in damages to Smartflash after being found guilty of willfully infringing on patents licensed by the company. Smartflash's new case is based upon the same disputed patents -- relating to the access and storage of data, digital rights management and payment systems -- but for devices not included in the original lawsuit, such as the iPhone 6, iPhone 6 Plus and iPad Air 2. I think there was a post sometime back regarding Makerbot's parent company Stratasys laying off 1/4 of their staff, but a couple articles make mention of this lawsuit being something that shows that Stratasys can't get a break from. If they did in fact have production issues and could not resolve them over numerous RMA's, then I see the justification for the whole legal endeavor. Personally, I'm just somewhat releived that I've become aware of this potential design flaw before my company made a decision to invest in a Replicator for our prototyping work--it was on the shortlist as a replacement for our Da Vinci. Not so much anymore, but replacements are not exactly widespread. But I don't hold to any of the rumors that there's malice behind Makerbot's poor quality control, it's just that they don't have the experience and capacity needed that they thought they did and it's just simple incompetence. In fact, I think this is probably going tolead into the beginning of a major reformation of the 3D printing market. I've always felt that, despite the usefulness of 3D printing and the excitement it generates, it's a niche manufacturing segment that's being oversold and overhyped as something for the common consumer and simply causing frustration for the garage-based maker/engineer.
