probably not gonna sue or anything. im hoping (though I sound really greedy even though I just got hit) I can maybe get some compensation and then I can finish building my pc lol

Hmm. I'm not sure legally you would have had the right of way. A bicycle is considered a motor vehicle if it's on the road...so...if you were jumping your turn, you might have been at fault.

does not matter to the insurance, i know plenty of people who were 'technically' in the wrong, but they got "paid out" anyways. is it right, or wrong, its up to the insurance to decide that, they got the means and ways and the know-how to fuck anyone over, especially the little fish just getting by. heck I knew one guy, hes a guy from the street, he was flying high and probably drunk out of his mind, who was riding a bicycle going the wrong way on the road, gets hit and luckily no major injuries and got $5k cash from the insurance. if he were to have broken a bone, i am confident that # would have triple or quadrupled. thats not even lost wages because they guy wasnt even working a legit job. another guy got hit on the sidewalk, riding his bicycle, which is 'technically' illegal as well and got paid off $8k.

i was chatting with an insurance adjuster type, and he said to me, you say ouch you get $5k, you break a bone you get $35k, you walk with a limp for the rest of your life, whatever that sum is, is then tripled.

i forgot to mention that pedestrian accidents are figured differently then auto on auto.

its not a matter of breaking the law, its not. the accident happened, now you are dealing with the after math. its not like you are willingly putting yourself into making an accident happen, which is a criminal offense. the driver is operating a deadly machine, and as such when people run from the cops, they are charged as such. attemtped murder, deadly weapon are common terms on the affidavet. mortal humans who are walking and riding bicycles are at a much higher risk of getting hit by ignorant and clueless drivers which is all too common.

@amdorintel That's not entirely accurate. You don't immediately get $35k if you break a bone. Every part of the body has a fixed value assigned to it. Lost wages is generally capped at a set value, far below what most people are likely to make. Yes, but if the other person is at fault, the insurance company won't pay out. That's kind of how insurance companies work.

it seems iffy to me because I usually ride on the sidewalk on the left side of the street on my way to school since the bike lane is pretty short in comparison of how long my ride to school is.

I was in the crosswalk when he nudged me, so I'm not entirely sure but I keep getting told I had the right away. Anyhow, it was both me and the guy since I went out and he wasn't looking right. I wish people wouldn't just look left because they're turning right, thats how I've almost been hit every time up to yesterday.

Yeah, it really depends on your local laws. For example, in a lot of places you shouldn't have been riding on the sidewalk to begin with, and you should have been walking your bike across the crosswalk. If you were on the road with traffic, it sounds like he would have either A) seen you, or B) you should have yielded to him.
