If nothing is broken... Why try to fix it?
Just because someone else might have issues, doesn't mean YOU will have them. Don't worry about it. You know it's a potential issue, if anything does happen, at least you know about it.

My coworker still uses a broken cup even though the handle broke and there's now a gaping hole on the outside of it where the handle used to attach.
A cup similar to this one :
He just put a piece of tape over the hole. Now it's a cup he gets to hold with his hands instead of with a handle...
People will use whatever they can as long as the core functionality doesn't change. Can it hold liquid? Yes? Keep using it then.
edit : just realized the forum apparently didn't accept copy/pasting of the images... even though it shows while editing once posted, it's gone. Damn it. Fixed the image.

This type of thing is perfectly safe.
All wireless signals transmitted by bluetooth, wifi, etc. are incapable of doing anything to us.
Turning it off when not in use would save some power but would make no difference to anything else.

Stopped using it 3 months ago. Replaced it with Reddit... Stopped using Reddit a few days ago.
The endless scrolling for quick content is everywhere these days and so easy to fall into when bored. Be it youtube shorts, instagram, twitter or some other social media... It's all cancer for your sanity.
That said, related to this topic... It's just the US fear mongering as usual. They are just mad they aren't the ones doing the spying for once.

You want to be mad, but don't want their help because their solution to help would somewhat inconvenience you?
Please realize that they don't have the drive in front of them, they don't see the files. To them, you just sound crazy person demanding them to send a flashdrive without providing actual physical proof. They are supposed to take your words for it?
Are you just looking to vent or something? It's a generic flash drive branded with their logo. Even assuming it was used and had random files on it... Delete the file and move on with your life. Don't be expecting top tier performances from a generic flash drive.

Depends on your budget.
AM4 with the 5800x3d would be a cheaper upgrade, since you would only need a cheap b450 motherboard and the CPU. Could ever get a used motherboard and potentially a used CPU as well.
AM5 would require you to buy new RAM as well.

I'm honestly not sure why you think this was a used hard drive. They manufacture an almost identical thumb drive with a USB-C interface. The PCB is almost certainly manufactured in the same run and if they aren't putting a USB-C port on it, they just leave the solder pins as is.
As for the System Volume Information, this is a normal partition on the hard drive for various Windows functions.
If I recall correctly, tons of flash drives used to come with some dropbox files/firmware pre-installed. I haven't heard of manufactures doing that in a while, but this may be a remanence of this old process.
Regardless, I'm still a bit confused why you think this flash drive is used.
I mean, it's probably because that's not the case.

Honestly. This sounded like two things. One is human error. It happens, and so far they seem to be doing what they can to fix the mistake. And two, you being in hurry and extra stressed because of that.
If you take a breath and think this through, nothing catastrophic has happened yet. You've lost maybe that $100 for express handling, and that's what you could be compensated for. But other than that, it seems like Systems76 is going through with standard process. RMA = return merchandise authorisation. Yes, usually related to warranty, but also just return of wrong products and purchase errors.
$3k for custom PC is not small fortune. It's big sum, sure. But at the moment, it's not lost money.
