The lower slot might be better for airflow which could lead to less throttling and more stable performance. The difference in bandwidth shouldn't affect performance much at all. 

How many times did you run the test?  
You should run it at least three times to get a measure of the variance.  Interesting result, I wonder what is causing it.

What are the walls/floors made of? I have tin-foil-like insulation between one of our wifi routers and our main living area and it's unusable.

Update firmware after a battery of tests then do the tests again. Networks are sometimes hard to set up nicely.

wtf is thermal overblow? you mean it was overheating? unlikely because the 750 Ti hardly puts out any heat and the reference one with the teeny tiny fan never hits 80c

Why did you disassemble it??? and scratching one of the pci-e 16x fingers wont do this, you could run the card in a 4x slot it would just have less bandwidth.
rebuild the card, make it look as legit AS POSSIBLE then send it in
