    AutoDS - facilitating dropshipping which most find to be a scam/get rich quick scheme. As I mentioned below the OP thread in the other forum, most people generally have a distaste towards dropshipping, etc. and for many viewers this would extend to the AutoDS sponsorship on this video. Most people who are aware of what dropshipping is, see it as a scam.

    Regarding the latest LTT video, did Linus advertise for a Dropshipping business? And ironically, this video is about a product that is likely scamming or duping through these Dropship sites. 
     
    It feels weird that he makes videos making fun of these types of sellers, such as Dup LTT products or haul videos from Amazon or Aliexpress.
     
    Most recently, Linus mocked dropship in his tech cleaning video with Luke.

    Thanks for the concern everyone. We are still in recovery mode over here and working with YouTube to get everything restored. Will hopefully have a video (or at least an update on WAN Show) to share with you all ASAP, but we want to make sure we get the details right since smaller channels may rely on our experience to help harden their own security.

    Funny how things go sometimes, I was working on my own all-noctua build PC as I just saw the latest video on the LTT channel so I thought I'd share mine here.
    I wish I had the same kind of tooling to do the same king of mods on my motherboard but I kept things simple and only painted the case itself.

    The case itself is a bequiet pure base 500 with a truckload of NF-12x25 all around to keep the 9900k at reasonable temperatures.

    Tbh i've never heard of Megapro, seems they're a brand sold in Canada though, their tools are made in Canada and have a lifetime warranty. I agree with the other mentions a tool with a high price tag should carry a lifetime warranty, i'm not sure people buying this tool will actually use it, but high priced tools get used until they break and there needs to be something more than "my merch is great and we'll support anyone that has any problems".

    It's obviously still up in the air, as Linus has said a few times, but I feel like it should be clear.

    Any tools, with a high price tag, advertising claims of "high quality" need to be backed by a lifetime warranty.

    I work on cars, computers, consoles, popcorn machines, whatever. I like maintaining things, repairing things, learning things. I've bought cheap tools before and I've bought expensive stuff before. Harbor Freight? CHEAP, screws literally falling out of torque wrenches. But, it's got a lifetime warranty so it's a one time purchase with a 10 minute drive every few years. Expensive snap-on stuff I got second hand? Unstoppable, but I'm not opening a credit line or buying anything new.

    For something as common as a screwdriver, being subjected to everyday use, especially for people who work with their hands, if I'm dropping $70, there's gotta be something beyond, "trust me." I want parts available for years to come. Stripped the threads on the "magazine"? I should be able to get one shipped out to me. Even if I have to pay for it. A bit got destroyed on a stripped screw? A new one (the special LTT size) should be available. The handle cracks in my toolbag? Same deal.

    It's not that you're buying a product with a general "Oops, bad batch" warranty. At a premium price point, for tools specifically, you're buying something for life, no ifs, ands, or buts. 

    I don't know if that's actually feasible for LTT, Snap-on obviously makes money through predatory credit schemes and having thousands of tools, but I'd like to at least see commitment to replacement parts being available for at least a decade.

    I'm not in the market for a screwdriver (I don't see the point in a ratchet mechanism on a fine thread machine screw) but I'll respect the pain in the ass of having one manufactured from scratch-ish.
     
    General comment though: for the price I'd expect lifetime warranty on the bits and somewhere in the US handling warranty claims.   However I suspect the majority of purchases are just going to be more for the "omg Youtuber merch!" aspect than "I really need a ratcheting screwdriver".  I'd still be amused to watch an AvE review of it though.

    From a PR standpoint that's probably the better idea.
    On the other hand, I like how "personal" LTT can feel sometimes. The combination of chats on the WAN show and actual human responses like this. I personally prefer this over the often overly correct messages most companies put out that just feel disingenuous.

    The truth is I'm kinda having fun with it.
     
    I used to argue on the internet a lot in my youth. Usually about how anyone could be stupid enough to pay more for an Intel CPU that performs worse than an AMD or similar. 
     
    My final word on this was my reddit post. The dev and I have mutually agreed that this is settled, which makes every single other involved party a white knight.
     
    I likened it to shooting tuna in a barrel when someone internally asked me the same thing earlier today. 
     
    As for why I'm writing this right now, I'm sitting in a boring meeting where I have to supervise, but I'm not actually required to interact 😛

    I don't understand why this has gone off the rails. The situation is simple, Linus f'd up, realised he did, owned up to it and tried to put it right. What else do you want him to do? He paid for the licence when he realised he needed one. 
     
    What he did wasn't piracy, for piracy he would need intent. From everything he has said, he just didn't realise you needed a commercial licence and thought it was freeware. As soon as he realised he paid for the licence lol
     
    This whole thread has become a circle jerk of those angry about his previous comments surrounding piracy and Ad block and this situation is been used like a club to beat him over the head instead. 
     
    Let's be really honest with each other, at some point in our lives we have run software that we should of paid for, but hadn't and either decided to carry on using it, or pay for it. Linus took the decision to do the honorable thing and pay for it, in my mind that should be the end of it

    Demonstrating how to use it: yes is educational, but doing a stress test and just including the software is commercial use as it is one of the main points of using the software. Suppose FurMark were to be paid software, you would need to acquire a license as you use it to test the systems you are working with to create your videos. This same principle holds for OCCT, you use part of it to test a system to create a video. Maybe you could have contacted the owner and discussed the educational/promotional aspect? Yes. But the discussion is the key for the entry into the educational/promotional domain for this type of use.
     
    I'm not saying there is ill will from LTT, someone probably found the software, saw it work well, didn't see the somewhat hidden commercial use licensing and used it. Buying the license is the correct solution now and maybe added policy at LTT to consider the possibility of needing to acquire a license of software used.

    I'm quite surprised at the response that Linus is getting here.
    To be frank, I barely watch LTT simply because I like a calmer, more objective style from other creators. That said, the post on reddit sounds as if the OCCT dev is trying hard to play the "persecuted christ" role here. He comes across as too nice that it is almost disingenuous. If he was so upset about the whole thing, I would have expected a lot more aggression from the dev if he truly feels mistreated.
     
    If he is truly afraid of Linus's retaliation, there is always the option of running to reddit or twitter with the email exchange. Instead, him going straight to reddit after a weak attempt to contact LTT for correction of the issue makes it seems like sympathy from the public was his original goal.
     
    If you read the reddit post, the whole thing is a masterful application of pathos. He went from lamenting about how "small and insect-like" he is in the face of "Linus the giant" to directing our attention to his home situation. While I don't doubt what he says, there is no reason to publicize your life other than trying to garner sympathy. But perhaps that is a decent business strategy.

    Once a fire has been started on the internet, you cant bring it under control.
     
    First off, Linus used version 5.5.7 of OCCT. Does anyone know if back then if the software had commercial licenses available? Truly asking, as while I see that today, OCCT does have paid versions, it is also on version 11. Just curious if 5.5.7 was free and then later version introduced the commercial license options. Remember, can't go by what there is today, but by what version he was using.
     
    From my point of view, and I have little knowledge on this topic, but the original Dev just handled this bad. 
     
    My cynical side says the Dev planned for it to be like this. I mean he tweeted about it back in May 24, 2021. Thanking them for it, for a video that took place back in June 2020. 
     
    Get why the Dev tweet would come late, as he probably only learned about it then. But if he was dissatisfied enough to write about a big post about it, why did he not ask back then in the tweet?
     
    Then, this whole thing seems to have stated from Reddit user Aeryn. Who claims he is a friend of the Dev.
     
    Says he tried reaching out to Linus about it, but it seems he never emailed. The only proof I could find of Aeryn trying to contact Linus was through TWITTER, in a imgur Screenshot he uploaded. Aeryn only replied in tweets saying he pirated the software. Claims he never got a response.
     
    I believe he never got a response for a few reasons. One, for issues as this you should try contacting the company's email address, or at the very least be the DEV giving the tweet. To my view its just a random person saying sh*t. Bet this would have been solved much faster if they sent an email to them directly.
     
    But then again, OCCT wouldnt be getting as much publicity if that happened.
     
     
    TLDR:
     
    Part of this feels like the Dev or "friend of the dev" purposefully avoided trying to solve this matter privately through email. Why? Because Dev said it himself. He is  not making enough money right now. What better way to bring in more then spread awareness of the product. How to spread awareness? Light the fire's with a well known Tech YouTuber in public and let it free.
     
     
    Again, that is my cynical side thinking. Could just be Dev had a friend who tried all the wrong ways to contact LTT for his friend who had previously thanked LTT for using his product, but never brought up any problems, bring up a problem to LTT.

    Some of the legal takes on here are so bad I decided I had to chime in.

    I am not your lawyer. this is not legal advice, this is for educational purposes only. All this information is jurisdiction dependent but does give an overview on how different jurisdiction view these issues.

    1. In many jurisdiction long form EULA's are not binding, furthermore in basically all jurisdiction if the software can be downloaded and the EULA not viewed it is also not binding. You are not required to seek it out, it has to be prominently displayed for you when you are installing the software and actively inform you of the intended use.

    2. Commercial use, is a defined legal term. Obviously this depends on the jurisdiction but just because and entity is commercial in nature does not mean every action it takes is of a commercial nature. It is not clear that LTT's usage of the software was of commercial nature, this is exactly the type of file that would require a court to resolve.

    3. Copywrite law is a lot more complicated than you would think, with every jurisdiction having its own particularities. In some jurisdictions to make a copywrite infringement claim you must prove monetary damages, in this case the exact opposite case could be made. If this is the case then no copywrite infringement was actually made.

    4. The developer thanked LTT for showcasing his software. Once again this is jurisdiction dependent, but not enforcing a contract claim and appearing to assent to it's breach offers some indemnity to the other party.

    5. To show-case the complexity of the law in some jurisdictions, if LTT was to use OCCT again after the Tweet thanking them for their showcase, and then a claim of copywrite or other licensing breach is brought, LTT may have a counter-claim for unjust enrichment against the developer. This could be construed as the developer assented to the free usage of their software in exchange for a demonstration by LTT. Due to the fact that LTT's commercial operation revolves around the selling of add space, the amount of advertising LTT gave the developer is easily provable, coupled with the fact that other software could have been sourced for free or even paid them to showcase, this amount could be claimed against the developer. Once again this would be a very complex file that would require a court to resolve.

    In summary, it is much more complicated than LTT pirated Muh software. Should they have paid, obviously for PR reasons. They should also have internal processes to reach out even after paying before they showcase any software, you never know when a developer could get antsy...

    Can we all take a moment to stop and acknowledge the fact that the dev responded to linus' response in the original reddit thread, and in that response he seemed appreciative of the fact that linus addressed the situation in the way he did, and that he never intended for this to blow up like this? He also said he was open to the possibility of working with LMG in the future, so the way I see it this whole situation has been resolved.

    Anyone who thinks he did it intentionally isn't thinking straight. It's highly unlikely he's even in the know about things like this, he just sees the program on there and thinks someone else has dealt with it. He's not going to go to Accounting each time he sees something new.
     
    As for the post/rant the dev made? A little misplaced, I think. As soon as you say "I would have given it to them for free" it kind of invalidates the entire reason you posted. Sure, I get that you wanted the reach out, but you can't cry about lost funds after you've said you wouldn't have charged them because you understand the exposure is worth far more than the cost of the license.

    The people still calling out Linus's adblock=piracy take have either not listened to what he said or are deliberately missing the point for an agenda. I hate to be defending a rich man and his company, but this line of attack is borderline delusional. Linus was not passing a moral condemnation on people that block ads. His was a philosophical point. A semantic point. He was talking about the definitions of words. His point was almost entirely restricted to the realm of linguistics. All he said was by definition, consuming content you agreed to watch ads to access without watching those ads is SEMANTICALLY analogous to using paid software without paying. This was a philosophical, not a moral point. He was not passing moral judgment on anyone. 
     
    That said, parts of Linus's response were gratingly passive-aggressive in a way only a Canadian can be (I say this as a Canadian). Either come out and attack someone explicitly or keep your mouth shut. This fake subtle shit is pathetic. Particularly his quip about the dev writing a "novel" on Reddit is underhanded and shameless as all hell. If you think the dev was in the wrong, say it in as many words. Acting like a Machiavellian fox is absolutely bottom-of-the-barrel pathetic.
     
    Also, Linus, I am not a lawyer but I find your insistence that you weren't using the product commercially because you weren't using it for its "intended purpose" a flimsy excuse at best. If I rip a YouTuber's thumbnail off because I like the image and use it in my video as a floating graphic, it does not mean I am in the right simply because I did not use it as a thumbnail.
     
    However, I am still a fan of Linus and his work, and his channel is one of my favorite on YouTube. I just point out when people I like engage in what I see as bullshit. 
     
    Finally, I believe that, in this particular instance, the dev is in the wrong. It seems like he was doing this for clout. It is discourteous and uncalled for to address something like this in public before making an effort to correct it in private when it is clear there is likely no malicious intent behind LMG's actions. Particularly suspect are two of the dev's actions:
     
    1. His 180 from thanking Linus on Twitter to attacking him on Reddit. 
    2. Ending his response to Linus's comment on Reddit by saying, "I hope we can work together in the future."
     
    I do not claim to know the man's mind, but this smells fishy to me. It feels underhanded and like he's doing it for clout, particularly when you consider that he has no problem with YouTubers using his product for free and that he was willing to hand out a license to Linus for free too. Excuse me, but what's the issue? There's nothing wrong with wanting to get paid for your work, but if you want that but also in the same breath imply you're okay with not getting paid for your work, what standard are people supposed to judge their actions regarding your product against?  
     
    Lastly, @Annika, you are embarrassing yourself. At first you had some semblance of a point, although I disagreed with you, and, honestly, was alarmed at the amount of passion and vitriol you came at LMG with, you have lost the plot entirely now. Spazzing out and frothing at the mouth about your credentials is never a good look. Nobody cares what degrees or position you have. Argue with your points; don't demand people's qualifications and credentials on an anonymous forum. Your occupation is not a citation.

    I'm not sure if I'd go that far. There's some really great folks here: people that truly care and spend their free time helping others. It just these faux controversies that always kick up a hornets nest for some reason. Don't let a few bad apples spoil the bunch for you, though. These forums are great and so is the community.
