all ryzen 3 cpus will be a downgrade, the 1400 and 1500x will be sidegrades and the 1600 series and above will be an upgrade. if you're just gaming, an i7 47xx or e3 123x v3 will be a better upgrade.

It's technically not piracy, but it's not particularly legal either. It's certainly against PSN's terms of service, but that doesn't make it inherently illegal, more of a grey area. 
 
Either way, it's a bit dodgy. 

It performs similarly to the 212 Evo but is much quieter. I don't think there's support for AM4 with it though.

Normally there's a little bit (like 2mm maybe) of fudge factor in this specification, I've seen people install a Dark Rock Pro 3, a 163mm tall cooler, in a NZXT S340, a case with supposedly only 161mm of CPU tower clearance.
 
Additionally here's a build that puts a hyper 212 evo in this case, it's only 1mm different in height so this is basically representative of what you'll see.
I won't be helpful enough to give any outright recommendations but it looks as though the S340 might work fine, and I can vouch for it in other ways as an owner myself.

For that budget I'd go with a more expensive processor  ok...

That's great that just means pc part picker is wrong  Proceed with the Asrock if that's the one you want. I was just being cautious and trying to make sure a mistake wasn't made.

Well, that depends what you are aiming for. For higher OC, yes. With Ryzen, maybe mid level OC also yes. For just basic cooling power, no.

You don't need to buy from the pc part picker links but its good practice to do virtual builds there as the compatibility checker is a pretty awesome free tool  Check your build has no issues, get a rough idea of prices and then buy from wherever you like - its still a good resource
