Weird Zero Escape 999 problem...

With the announcement of Zero Escape 3 I finally decided to go back and play the first two games of the Zero Escape series because I've heard nothing but good things. I got a new copy of the first game, 999, for DS and began playing is on my 3DS XL today but it won't let me save my game. The game tells you over and over again to just press "Start" and it will let you save anytime, but every time I try I get a message that says "Could Not save". I'm about 2-2.5 hours in and have been trying to save off and on but never any luck. I've tried before a puzzle room, after a puzzle room, during a puzzle room. Nothing.

 

Just wondering if anyone on here has played the game and if so did you have any issue with saves?
