Ducky Legend Question

So I've been using my first mechanical keyboard for awhile and recently I had a look at the LED Customization Mode. The keyboard has been perfect for me so far, but in the customization mode I have had one major problem. You can select which keys to be lit up and save it in the in-built  memory and I can do that fine. Once I've saved it  and changed the brightness of the LED's the back-lighting on some of the keys goes out. Then when you flick through the brightness settings the LED's can show some light for like a nanosecond while flicking through. Then when you go back in the customization to turn on the LED's you have to press down on them twice because I believe when you press it down the first time it still thinks the LED is on. The weird part is if you adjust the brightness then and turn back the LED's in the customization mode they can become brighter as normal. So all in all it only really happens when you flick through the settings. 

 

It gets weirder though, it only affects certain keys like, the space bar, number pad +, number pad 0 I believe, BOTH shift buttons and a few others. I'm wondering whether this is a faulty keyboard or most likely if it's a problem with the firmware because it only really affects certain keys and it doesn't happen to any of the letter keys or really anything else besides those that I listed. This also doesn't happen in any of the other modes. I don't really think this affects me that much because I only use the backlighting mode and not the customization ones. 

 

As I stated above, I believe this to be a firmware issue and if not, should I return it or contact Ducky?
