Nintendo Hates Free Advertisement

Nintendo is being Nintendo again, There is a guy that did HD Remaster of Mario 64 level and guess what Nintendo did?... Flag his video for copyright!

I ask this question to the consumer do Nintendo hates free Advertisement? Because it seems like they do there is no other developers that has this problem showcasing there game like Battlefield for example if you had a beast gameplay and want to show it off to people EA doesn't have problem same goes for 1st Party devs. But if it's Nintendo be prepare to get a strike on your channel, Nintendo needs to learn free advertisement is good a thing and it puts money in your pocket look at Minecraft and Mobile game Floppy Bird for examples.

Nintendo is so out of touch with the Gaming Community and I believe if there new console don't sucessed and do poorly like the Wii U Nintendo is dead.

They flagged the video because they got the game offline too.

 

this is not even legit free advertisement for Nintendo, this is not their game.

It's a fan remake of a game of Nintendo. A fan remake that people can download for free and Nintendo is not making money off it.

It uses Mario, a something owned by Nintendo and you can't just use it.

This has been discussed a thousand times, and should be widely known to youtubers not to touch nintendo unless they have agreed to their terms

 

Also, if the guy was playing a remake of the game, using unauthorised nintendo assets, they have every right to shut his videos down

I really don't have an issue with this. This is one of those shady grey areas inbetween whats ok and whats not. To infringe Nitendos IP and turn it into a propaganda piece for a group is pretty hardcore against the law in many places.

 

Do I condone nitendo being asshats about every single piece of their IP? No. But can i blame them for enforcing their rights? No. 

While i wish that they could adopt a more lenient policy when it comes to this kind of stuff, I know it wont happen.

I don't see any problem with other people broadcasting their Nintedo IP
I've seen lot's of video playing MarioKart and Super smash bros

 

not to mention all old mario brothers video (even linus has video with that game playing using emulators)

That IP is made by Nintendo though, unlike the remake in the flagged video.

That's just the thing. Nintendo flagged this video not because it was showing a Nintendo game, but because it's an unlicensed, unsanctioned usage of Nintendo ip, being used to forward the prospects of a nonaffiliated studio.

This is akin to stealing someone's homework, changing one answer and slapping your name on it. It's just plain illegal in most cases.

There's a quite a few things related to property law and trademarks and so forth, but mostly, the general policy is "use it or lose it". For most companies, it is in their best interest to protect their property at most given opportunities, so long as the process is not extremely pricey. 

 

One thing you should note is that Nintendo is a Japanese company. The country's debt/GDP ratio is high, the population is aging, pretty much nobody uses a computer (making it so that really innovative and productive things don't happen), and there is basically close to zero economic growth. As a result, there is no trend in Japan of creative marketing in that sense, since one person doing well happens more or less at the expense of someone else. As a result, Nintendo is slow to adopt more "western" advertising practices. That being said, that may not be the exact reason in this specific case, as some others in this thread have outlined.

Nintendo won't die. They can bleed 250 million dollars for 40 years and they still wouldn't be bankrupt. Also Nintendo are very successful in the handheld market.

Nah I'm not. You're kinda forgetting last gen where Nintendo was just dominating in terms of sales in both the home console and in handheld gaming. Also their amiibos are doing pretty well.

Let me fix that for you:

 

I think you need to update that best selling consoles of all time list. Because the PS4 is the fastest selling PlayStation and the best selling console of 2014. Neither of which your list actually disagrees with, TBH I don't quite understand the difference between yearly sales and lifetime sales. Did you know that the PS4 and XBOne have already have a bigger install base than the Wii U? I mean you didn't even bother to rank the Wii U in that list. Clearly you must think the PS4 and XBOne which you put at #18 and #19 haven't sold better than the console you didn't even put on the list. That's how ranked lists work right? However I did notice that the 360 has more units out in the wild than the 3DS as of now, not that it matters it's just a random fact. There are also more Atari 2600s than PS4s out in the wild. How about that!

 

Anyways, Nintendo is doomed because it's the fashionable thing to say. And I'm an authority on this because like most people in my 20s I had an N64. I'm sick of Nintendo doing different things and not being the cool console manufacturer. I'd rather they just go away so there'll be less competition in the gaming industry. I like the prospect of not having a company that has enough balls to release a game like Splatoon in a marketplace full of "serious" games. Like most gamers I ask for new IP and innovation but actually just end up buying the newest Assassin's Creed, and Ubisoft treats me well for being a sucker like that. Also while we're at it lets burn down Pixar, from now on I only want to see movies like Transformers and Avatar.

 

And while I'm here have another list. The three best selling platform each year for about the last ten years:

They are protecting their IP and trademark.

Sega, Capcom and others does it as well. If they don't take action, then their trademark turns into public domain.

While some companies are willing to take the chance, others don't are the law requires them to take action.

That is for taking down the game

As for YouTube story. Nintendo has not adapted, and won't adapt any time soon. Nintendo is far from a new executive to come in and move the company in a different direction. Replacing Iwata (Nintendo current president and CEO) would only mean that the Nintendo family will elect someone that follows the same old ways, so nothing will change. And Nintendo action, policy and direction aren't badly seen in Japan. And it doesn't help the fact that Sony that does things bit different is not doing well. Giving more reason for Nintendo to stick their old ways. Nintendo doesn't see console sales numbers as the only indicator of success. The first party game success and mark on the culture is the big factor. If you check out interviews from prominent figures at Nintendo, you'll see that this is true.

With the youtube thing in general Nintendo are a bit heavy handed and I don't think it's a good thing at all. But they're more than free to do it because it is their IP. In the same way that producers of other content like music, movies and TVs are allowed to take that sort of action. But the thing is that in general they don't actually take the videos down. They just remove your ability to make money from it unless you become a partner network. Something which I don't really agree with either but still, lets get some facts straight please.

 

That said, the video that this thread is about? We're talking about an entirely different sort of thing. This isn't simply a lets-play video. This is a video premoting a fan-remake of a large portion of Super Mario 64 using Super Mario Galaxy assets. A fan-remake which gained some traction and co-incidentally came out the week before they started putting N64 games on the Wii U Virtual Console. To use an example from another company, do you think Microsoft wouldn't have come down hard on an unofficial "HD remake" of Blood Gulch? What if they came out with it the week before the Halo HD remake on XBOne? I'm not saying I'd agree with it but I can understand why and I'd suspect most other companies would react the same.

 

The third bit of this whole thread are the predictions of doom. And sure, the Wii U isn't flying off shelves. But it is a good console whether people choose to believe that or not and Nintendo has enough of a buffer to ride out the storm. The idea that Nintendo are somehow going to die because of their backwards policies with regard to youtube? Or in particular their iron fisted protection of their IP? I think it's a pretty thin theory. The only way I can see Nintendo dying is if they fail on their next portable, their next console and then again. Which is something none of us, whether we like Nintendo or not, should be wishing for. Plus even if that did eventuate they'll still live as a highly regarded game developer for a fair while after that.
