I mean it under amazons 30day thing i could just get a new one

It's fine, don't worry about it. 

 

And yes, it's a bios setting -- you want to make sure the CPU Vcore isn't on auto whenever you run p95. 

Temps are fine for a stock cooler.

as long as it is below 85C under full load it will be fine :)

alright. do you think it being at 108C for about a minute hurt it?

If it spiked to 108, and you cooled it down, it should be fine.

 

Leaving it at 108 is where you'll start having issues.

It can only get damaged if its at 100+C for several hours

couldnt figure out if it started yet and then i looked at the temps.... motherboard was hot aswell

You shouldn't run Prime 95 on a Haswell chip unless you have the cpu voltage set to a fixed number.

Prime95 drives the voltage up higher than it needs to and can cause damage to Haswell chips.

so should i return it? after i got the new thermal paste i ran it again for about 5min it only got up to 70C  does it keep driving the volt up?

No, it's fine, don't worry about it. Just don't run Prime 95 unless you take it off of auto voltage.
